As art does not generate any cash flow, its value is solely determined by demand and supply. One important aspect affecting demand is an artwork’s provenance. Having been part of a high-profile collection oftentimes has a positive impact on an artwork’s demand and therefore price. The De La Cruz collection that is going to auction now is a good example. Choose your charitable beneficiaries carefully. There is a crisis in board leadership across the country. There seems to be a trend towards rewarding an institution's fiduciary incompetence with relief from obligations to fulfill donor-imposed restrictions on assets held in trust. The offending entity should not be able to "benefit" from their incompetence. Future donors might consider contingency clauses in their gift agreements that would transfer the assets to another public collection should the charity be unable to fulfill their duty to abide by the donor's restrictions.

The idea that a gallery should guarantee a certain number of sales to any artist they show makes about as much sense as an artist guaranteeing a certain number of sales to any gallery that shows their art. Galleries do their absolute best to pick artists whose art they believe they can sell. Likewise, artists should do their absolute best to work with galleries they believe will be able to sell their art. Responsibility for making informed decisions lies with all parties, not just the galleries.
