A pivotal Human Rights Tribunal of Ontario ruling reaffirms the imperative for employers to rigorously investigate harassment allegations. In the matter of S.E. v 2474489 Ontario Inc. (operating as Opa! Souvlaki), the tribunal levied a $35,000 fine for the employer’s neglect in investigating sexual harassment claims. This case accentuates the legal necessity for employers to enforce effective anti-harassment policies and procedures. Did You Know? 🤔 New Employer Obligations from October 26th Proposed new legislation on workers rights has hit the headlines, but it is clear that it will be a while before this is finalised and enacted. However, there is a law that employers must comply with, this month. From tomorrow, the Worker Protection (Amendment of Equality Act 2010) Bill will bring new responsibilities for employers to actively prevent sexual harassment in the workplace. They will have a duty to take “reasonable steps” to prevent harassment while Tribunals will have power to increase compensation for breaches.
