📣 U.S. Sanctions Target Houthi and Hizballah Trade Networks 🚢 On August 15, 2024, the U.S. Department of the Treasury's OFAC imposed sanctions on several companies, individuals, and vessels involved in shipping Iranian commodities to Yemen and the UAE for Iran-backed Houthi financial official Sa’id al-Jamal. Sanctions also target Hong Kong-based Kai Heng Long Global Energy Limited for its role in shipping Iranian LPG for Lebanese Hizballah. ✅ These actions aim to disrupt financial support for the Houthis and Hizballah, which are involved in destabilizing activities in the region. 📣 Treasury / OFAC Tightens Sanctions on Belarus’s Military Support to Russia On August 9, 2024, the U.S. Treasury's OFAC imposed sanctions on 19 individuals, 14 entities, and one aircraft linked to Belarus for their role in supporting Russia's war in Ukraine and aiding the Lukashenka regime. 🎯This action targets: - Entities and individuals aiding military resource production and sanctions evasion. - Belarusian companies involved in supplying military components to Russia. - Private cargo airlines supporting Russian defense activities. - Logistics companies re-exporting goods to Russia and generating revenue for Lukashenka's associates. ❌ The sanctions block all property and interests of these entities and individuals in the U.S., with strict prohibitions on transactions involving them. The US has amended the Export Administrative Regulations (EAR) so that individuals and entities designated under certain OFAC sanctions regimes (Russia, counter-terrorism, proliferation, and counter-narcotics) will also automatically be subject to certain export controls under the EAR. The new rule imposes end-user controls and EAR licence requirements for all items subject to the EAR for all persons blocked under 11 OFAC-administered sanctions programmes (7 related to Russia and Belarus and 4 related to counter-narcotics) and continues to impose EAR licence requirements for 3 OFAC-administered sanctions programmes (2 related to terrorism and 1 related to proliferation). Previously, the EAR imposed licensing restrictions on all items subject to the EAR for only the 2 terrorism sanctions programmes and the proliferation programme, and imposed licensing restrictions only on luxury goods for individuals designated under 7 of these sanctions programmes related to Russia and Belarus. Yesterday, 4th April 2024, the United States issued new Iran-related counter-terrorism sanctions. These new sanctions have been placed on Oceanlink DMCC and its vessels for “facilitating the shipment of Iranian commodities on behalf of Iran’s Armed Forces General Staff (AFGS) and the Ministry of Defence and Armed Forces Logistics (MODAFL).” The US Office for Foreign Asset Control (OFAC) stated the role the shipping group plays on behalf of the Iranian military, including a the Oceanlink DMCC manged vessel HECATE, which recently loaded Iranian commodities valued at over $100million dollar via a ship-to-ship transfer from one sanctioned tanker to another. Additional information provided by OFAC detailed Oceanlink DMCC’s role with Iran, the group operates a fleet of over a dozen vessels which are deeply involved with Iranian commodities on behalf of the military and by extension US sanctions evasion. US Under Secretary for the Treasure for Terrorism and Financial Intelligence Brian E. Nelson said, “We are focused on disrupting Iran’s ability to finance its terrorist proxy and partner groups and support to Russia’s war of aggression against Ukraine.” Ship to ship (STS) transfers can be used as a sanctions evasion method, as seen here, are just one of the ways that those seeking to circumvent or evade sanctions. We have routinely seen such activity taking place in the North Korean Exclusive Economic Zone, as North Korea seeks to evade the impacts of UN sanctions. This is just the latest example of these methods being used. Other sanctions evasion markers and techniques in the maritime space can include identity laundering, complex ownership structures, AIS manipulation and falsification of documents. Recent updates from the Office of Foreign Assets Control (OFAC) highlight several significant developments in sanctions programs. Key updates include; Russia Related Sanctions - On June 7, 2024, OFAC implemented additional designations targeting individuals and entities supporting Russia's military-industrial base under Executive Order 14024. Iran Related Sanctions - On June 10, 2024, OFAC announced new designations under its counterterrorism authority, targeting entities and individuals linked to Iran's activities that threaten international security. Counter Narcotics and Terrorism Sanctions - Recent actions on June 6, 2024, include designations related to counter-narcotics efforts, targeting organisations and individuals involved in illicit drug trafficking and associated activities. This includes new sanctions on entities in Sudan and individuals linked to instability in the West Bank. OFAC updates can cause a-lot of noise for compliance teams within Financial Institutions.
