July Visa Bulletin 2024 Brings Surprise News for Indian Applicants! Hey folks, the July Visa Bulletin 2024 is out! Let's quickly dive into the final action dates movement for India in the EB1, EB2, and EB3 green card categories. 1️⃣ EB1 Category: 🔸There is good news for you! The EB1 final action dates for India saw a significant movement of almost a year, from March 1, 2021, to February 1, 2022. 🔸If your priority date is on or before February 1, 2022, you can file your adjustment of status application with the USCIS. 2️⃣EB2 and EB3 Green Card Categories: 🔸The EB2 final action date for India advanced by two months, from April 15, 2012, to June 15, 2012. 🔸The EB3 final action date for India saw a slight movement of one month, from August 22, 2012, to September 22, 2012. It is important to note that you must use only the final action date chart in the July Visa Bulletin. As you can see, the EB-1 or EB-1A final action dates move much faster than the EB-2 and EB-3 green card categories. Even more importantly, if you have a priority date from the EB-2 or EB-3 categories, you can reuse it for an EB-1A petition, potentially fast-tracking your green card process and bringing you closer to achieving your American dream. The August 2024 Visa Bulletin is out. Are you concerned about visa retrogressions? No need to worry! It brings positive updates for Indian applicants. 1️⃣ EB1 Category: The EB1 or EB1A final action date for India remains February 1, 2022. 2️⃣ EB2 Category: For EB2, the final action date for India has moved by one month to July 15, 2012. 3️⃣ EB3 Category: Last month's Visa Bulletin hinted at potential worldwide retrogression in August 2024, but nothing of the sort has occurred. The EB3 final action date for India has moved by one month to October 22, 2012. It is important to note that you must use only the final action dates chart in the August 2024 Visa Bulletin. November Visa Bulletin 2024 is Out! Are there any significant changes in the Final Action Dates for Employment-Based Green Card categories for India? Let’s break it down: 1️⃣ EB1 Category 🔸For the EB1A category for India, the Final Action Date remains unchanged at February 1, 2022. Unfortunately, there is no movement here for now. 🔸The EB1 cutoff dates in the Date for Filing chart also remain the same, which is April 15, 2022. 2️⃣ EB2 Category 🔸In the EB2 category, the Final Action Date for India stands still at July 15, 2012. 🔸The EB2 cutoff dates in the Date for Filing chart remain unchanged at January 1, 2013. 3️⃣ EB3 Category 🔸For the EB3 category, the Final Action Date for India is November 1, 2012. 🔸There are no changes in the EB3 cutoff dates in the Date for Filing chart, which is June 8, 2013. In short, there has been no movement in the Final Action Dates for the EB1, EB2, or EB3 categories for India. But here is the good news: USCIS stated that the Date for Filing chart can be utilized in the November 2024 Visa Bulletin, which provides earlier dates. While this November Visa Bulletin didn’t bring the changes we were hoping for especially for EB1 applicants; there is still hope for progress ahead. Today, the September 2024 Visa Bulletin was released and we are seeing no major changes. Insight from Attorney Kim "The U.S. State Department projects all available green cards to be exhausted when the fiscal year ends on September 30, 2024. This means that applicants with pending green cards with current Priority Dates in August and September may not receive a green card approval if all available green cards are used before September 30, 2024. Applicants should be ready to remain in pending Adjustment Status and renew their EAD and Advance Parole as timely as possible. When the October 2024 visa bulletin is updated next month, there will be an assumption that Priority Dates will advance but expect advancement to be modest if any. The past 12 months have shown no slowing or decrease in green card demand across all categories thus, expectations should remain very conservative and appropriate steps taken to maintain status or remain patient if processing is for applicants living abroad. As new information arises in the coming months, Visa Nation will update and adjust our predictions. In the meantime, trends in Final Action date movements are subject to change, and retrogressions are always possible due to fluctuations in applicant demand and other influencing factors. CHANGES ANNOUNCED THAT WILL AFFECT 457, 482 & 494 VISA HOLDERS FROM 1 JULY 2024 From 1 July visa holders will have 180 days between employers AND you can work for anyone and in any job during this time. Also, time spent between employers before I July won't count towards the 180 days. So existing visa holders will have 180 days to find another sponsor from 1 July 2024. These visa holders will have up to: 180 days at a time, or a maximum of 365 days in total across the entire visa grant period. June 2024 Visa Bulletin is out! Is there any movement in the final action dates for EB visas for India? Let's find out. 1️⃣ EB1 Green Card Category: 🔸The EB1 final action date for India saw no movement and stands on March 1, 2021. 2️⃣ EB2 Green Card Category: 🔸The EB2 final action dates for India remain the same as April 15, 2012. 🔸The EB3 final action date for India moved forward by 17 days compared to the May visa bulletin. It currently stands on August 22, 2012. It is important to note that only the final action dates chart in the June visa bulletin must be used for all Employment-Based green card categories. Furthermore, USCIS says that the EB2 and EB3 green card categories might experience retrogression in the upcoming visa bulletin because of huge demand. Also, USCIS will soon hit the maximum limit for green cards for this fiscal year, which ends on September 30, 2024. My friend in India has customers in Bay Area but hadn't ever traveled since he had no US visa. I helped him get B1 and he's coming tomorrow! Here’s a visa cheat sheet for Indian founders : • B1 is easy to get. Don’t worry about wait times in your city/country. There are ways around it. • O1 visa : Possible with some amount of work/funding/achievements. You can stay upto 3 years and can extend it. Very common path for founders. • EB 1 : you get a green card straightaway if you’ve done some extraordinary things. Check criterias and if you’re eligible, do apply! Some tips : - Ask for visa advice ONLY from optimists + those who have cracked it already. Naysayers waste your time and drain your energy. - Choose a great law firm, don't be stingy there. Do reference checks on firms. Some firms make you do a lot of work, avoid them. - For first timers, B1 is great. Once you decide that US is where you're going to build, only then work on O1/EB1. - Don't reject yourself. Let USCIS reject you. 😂 Just kidding. if you get RFE, you can still apply again. And get visa approved. Remember this - You cracked IIT/AIEEE/CAT/NMAT/XLRI/GATE/UPSC/Bank PO/CLAT/UGC NET/NIFT or a job in a country of billions. It’s way easier to crack US visa!
