The Special Court (Overseas Pakistanis Property) Act, 2024, as passed by the Senate of Pakistan. The Act fundamentally changes the way in which disputes regarding immoveable property in which non-resident Pakistanis are a party are adjudicated, introducing the concept of leave to defend in such matters, and providing the right to appeal to the high court. It also mandates the establishment of Special Courts for such property disputes, and fixes a timeline for the disposal of these cases within ninety days. The Act raises questions regarding the fairness of treating non-resident Pakistanis in a more favorable manner as compared to locals, but in any case, every step towards accessible, proportionate, and expeditious justice is always welcomed. #Pakistan #Supremecourt #Highcourt #OverseasPakistanis

*Lt Gen Faiz Hameed (Retd) has been formally arraigned on charges of engaging in political activities, violations of Official Secret Act,ISPR *Rawalpindi:On 12 August 2024, process of FGCM was initiated against Lt Gen Faiz Hamid (Retd) under provisions of Pakistan Army Act and in first place Lt Gen Faiz Hameed (Retd) has been formally arraigned on charges of engaging in political activities, violations of Official Secret Act detrimental to safety and interest of the state, misuse of authority & government resources and causing wrongful loss to a person(s). During the process, involvement of Lt Gen Faiz Hamid (Retd), in events related to creating agitation and unrest, leading upto multiple incidents including but not limited to 9th May 2023 incident for fomenting instability; at the behest of and in collusion with vested political interests, is also being separately investigated. Lt Gen Faiz Hamid (Retd) is being afforded with all legal rights as per the law.

On Wednesday (July 31), President Cyril Ramaphosa signed the Independent Police Investigative Directorate (IPID) Amendment Bill into law. This significant legislation aims to strengthen the independence and impartiality of IPID in investigating serious offences committed by police officers. Key Highlights of the IPID Amendment Bill: 1. Enhanced Independence: Affirms the institutional and operational independence of IPID, ensuring investigations are conducted without fear, favour, or prejudice. 2. Expanded Investigative Powers: - IPID can now investigate any deaths caused by police actions, whether on or off duty. - IPID is empowered to investigate rape by a police officer, regardless of their duty status. 3. Appointment and Responsibilities: - Updates provisions related to the appointment of the Executive Director of IPID. - Broadens the Executive Director’s responsibilities regarding disciplinary recommendations. - Includes pre-employment security screening investigations. 4. Savings Provision: Maintains conditions of service for existing IPID investigators and provincial heads. Background and Context: - The new law addresses a Constitutional Court judgment in the McBride v Minister of Police case, which invalidated certain provisions of the IPID Act. - It clarifies that the Minister of Police cannot take disciplinary action against the Executive Director of IPID without parliamentary oversight. - The amendment is a result of a comprehensive review initiated by the Civilian Secretariat for Police Service, which provides policy advice and civilian oversight of the South African Police Service. The Presidency emphasized that this legislation is crucial for ensuring that IPID operates independently and effectively in investigating police misconduct.
