For those of you not aware we are the Secretariat support for CLAW (Consortium of Local Authorities Wales) We are pleased to announce that the CLAW Awards are now open to submit entries, to enter you must be a member of CLAW, all 22 Welsh Authorities are members. Please see details below: As a CLAW member, you are invited to make a submission/s for the CLAW Project of the Year Award & CLAW Small Project of the Year 2024, which will consider schemes with the contract value of less than £1M. An additional commendation award may also be considered to projects that reach an outstanding standard in a particular area of the project’s delivery. This Project of the Year Award will be made in order to: Reward excellence Raise profile of CLAW within Authorities Raise profile of CLAW and its member Authorities in the wider professional property field All Authorities are encouraged to submit entries. ELIGIBILITY – PROJECT OF THE YEAR AWARD CLAW member authorities should submit projects of any contract value, that have achieved Practical Completion between 1st September 2022 and 1st September 2023. Buildings commissioned by, but not necessarily designed by, member authorities are eligible. Buildings must not have been entered in previous years. Each authority can enter a maximum of two projects. The Devil is in the (EFL Handbook 📚) detail. 𝐑𝐮𝐥𝐞 𝟏𝟎.𝟓 of Appendix 3 📖 largely went unnoticed when it appeared in the EFL Handbook last summer. The seemingly more interesting news at the time (covered extensively in the press 📣) was about the raft of new measures tightening up the EFL’s 𝑂𝑤𝑛𝑒𝑟𝑠 𝑎𝑛𝑑 𝐷𝑖𝑟𝑒𝑐𝑡𝑜𝑟𝑠 𝑇𝑒𝑠𝑡 to further weed out bad actors 🦹🏻♂️ 🚔. Hurrah 🎉👍! ⁉️Why then waste precious news space 📰(or X characters) on a seemingly innocuous rule buried deep in Appendix 3? After all, Rule 10.5 “merely” prohibits buyers and sellers of EFL clubs from 𝗳𝗼𝗿𝗺𝗮𝗹𝗹𝘆 agreeing a sale OR announcing 📣 it 𝐛𝐞𝐟𝐨𝐫𝐞 getting EFL approval. No big deal, right❓ Wasn't that always the case ❓🤷🏻♂️ Well, no. 🔙🔙 Before Rule 10.5, 𝐜𝐨𝐦𝐩𝐥𝐞𝐭𝐢𝐨𝐧 of a sale was subject to EFL approval. BUT a buyer and seller could merrily enter into a 𝐛𝐢𝐧𝐝𝐢𝐧𝐠 sale agreement 📝 and announce 📣 it — with EFL approval being just a closing condition. 👉 Enter Rule 10.5. ‼️ EFL clubs and owners are now prohibited 🚫🙅🏻♂️ from entering into a 𝐛𝐢𝐧𝐝𝐢𝐧𝐠 sale agreement 📝 and announcing it 𝐛𝐞𝐟𝐨𝐫𝐞 getting EFL approval ‼️ 👀 👀 Why the change❓ Frankly, to stop furious fans 🤬 taking aim 🎯at the EFL for not approving a prospective buyer. No binding agreement🟰no actual deal to approve or NOT approve🟰no angry supporters 😤. Or, at least that’s the idea. So, who cares❓What does it mean for a buyer of an EFL club? 🤔 For some, perhaps not much. Most non-Championship EFL clubs are not worth a lot. A buyer doesn’t need tens of millions 💰in the bank 🏦 to buy one. 𝐁𝐔𝐓 what about the Championship where at the start of a season clubs have a 1/4 chance of finishing in the top 6 and either being automatically promoted to the Prem 🤑 or being in the playoffs❓ Owners of Championship clubs (particularly those that ping pong 🏓 between the first🥇 and second🥈tiers of English football) will likely peddle valuations in the hundreds of millions 💰💰💰. Leeds, Leicester, Southampton anyone❓ ❓🤷🏻♂️ Is it realistic (or reasonable) to require a buyer of a Championship club to be sitting on hundreds of millions in cash when first approaching the EFL for approval 𝐛𝐞𝐟𝐨𝐫𝐞 a sale agreement is in place? ❓What if a bona fide buyer 😇 has some committed funds 💸 but needs to raise more to pay the seller 𝐚𝐧𝐝 pour equity into the club to cover the inevitable eye-watering losses😭? ❓What if that buyer can only fundraise off the back of a 𝐛𝐢𝐧𝐝𝐢𝐧𝐠 sale agreement 📝? Ladies and Gentlemen, we have here a classic 🐥 or 🥚. ⁉️ Did I mention the Premier League has no Rule 10.5 equivalent? 🤔 Presumably because PL clubs don’t want to restrict the universe 🪐🌗👽of potential buyers. ❓Is Rule 10.5 prudent policy that further helps the EFL weed out the rogues and tyre-kickers❓👍👍 ❓Or does it restrict Championship ownership to the uber rich and managers of large blind capital pools❓
