I keep seeing frustration on LinkedIn surrounding this, but I don’t see it or hear it anywhere else. Thats a problem, a major problem. Because the general public is going to get the products either way. It’s no mistake they are doing all of this during a time they have voters distracted with items that actually matter to them, inflation, childcare, etc. Outside of my LinkedIn Cannabis connections, most in the public (who I spend 99% of my time communicating with) have no clue or care about this. The politicians seats are not threatened by their voting constituents so they are going to do what the $$ gives them. And the $$ is big alcohol and big pharma crushing this industry until they control or are properly cut it on the money flow. I mean come on - how much have you all spent in lobbying already? Has it scratched the surface of your opponents? Can you keep up at this pace? Are you winning or just surviving another day? Anyone ready for that unified public service campaign yet?

A new lawsuit has been filed against the New York State Cannabis Control Board and the New York State Office of Cannabis Management. The lawsuit, filed in federal court, appears to be a permutation of a previous lawsuit by North Fork Distribution, Inc. involving hemp companies objecting to certain aspects of New York State's emergency #cannabinoid #hemp regulations. In that previous litigation, the #OCM and the Cannabis Control Board were enjoined (prevented) from enforcing certain emergency regulations relating to the contents of hemp products. Subsequently, the Cannabis Control Board adopted revised cannabinoid hemp regulations that require a 15:1 CBD to THC ratio--one of the regulatory requirements at issue in the previous litigation. The latest litigation argues that the adoption of this ratio was arbitrary and capricious, in violation of the State Administrative Procedures Act, and the hook for getting into federal court are numerous allegations of unlawful searches and seizures of hemp products. #cannabis #cannabislaw #cannabislitigation #cannabisnews

It’s clear that the cannabis industry continues to evolve rapidly, and recent developments are keeping us on our toes. The DEA’s announcement of a public hearing on the marijuana rescheduling proposal, scheduled for December, means that any significant changes to cannabis laws won’t happen before the election. Here is a copy of the New York State Office of Cannabis Management's public comment on the proposed #rescheduling of #cannabis under the Controlled Substances Act. In addition to requesting new guidance similar to the Cole Memorandum, the public comment contains a plea to address the differing treatment of intoxicating hemp-derived products and cannabis under federal law. Specifically, #OCM writes in its public comment that: "The current misalignment of the treatment of cannabis and hemp-derived intoxicating products is untenable for state regulators. States require clarity to set product quality control standards for all cannabis products, regardless of whether they were originally derived from hemp or cannabis. This is a major public health concern as similar products are operating under different regulatory frameworks creating significant confusion for regulators, businesses, and cannabis consumers." #cannabisnews #cannabislaw

Minnesota’s interim director, Charlene Briner, of the states cannabis regulator has called on lawmakers to amend legislation in order to help it achieve the goal of rolling out an adult-use framework by 2024. Minnesota legalized recreational cannabis for adults 21 and older on August 1, 2023.
