In California, field sobriety tests (FSTs) and the on-site (preliminary) breathalyzer test are considered voluntary before an arrest. This means you can decline these tests without immediate consequences from the Department of Motor Vehicles (DMV) regarding your driver's license. However, it's crucial to understand the distinction between pre-arrest and post-arrest scenarios: ### Pre-Arrest: - **Field Sobriety Tests (FSTs):** You are not obligated to participate in these voluntary tests. - **Preliminary Breathalyzer:** Similarly, this is voluntary before an arrest. Choosing not to participate in these tests can't be used as a reason by the DMV to suspend your driver's license. ### Post-Arrest: - **Chemical Tests (Blood, Breath, or Urine):** After an arrest for DUI, California's implied consent requires you to submit to a chemical test. '4,935 deaths or serious injuries from young driver crashes in 2022' The brain of a teenager develops in a different pattern - emotional development is far more rapid, with this being linked to an out-of-kilter balance to being able to judge risk - they seek the thrills and highs - speed is a thrill and a high. Their ability to judge risk is therefore massively reduced, blinded almost by the emotional thrill of that which speed generates. It's almost intoxication - the term 'boy racer' is around for good reason. Road deaths in this category will continue to stay high until something material is done, and a GDL is currently the best known instrument that will curtail adolescent road deaths. The very fact that in the countries where a GDL has been introduced has seen a range of reductions between 22 and 50%, just how can the current government ignore these statistics...(do they have children?). That number again - 4,935...
