Right now, tenants have limited options to challenge rent increases due to the threat of eviction under Section 21. Here's what they can (sort of) do: ➡️ Refuse a New Lease Tenants can refuse to sign a new tenancy agreement with a higher rent. However, this might result in eviction under Section 21, making it a risky move. ➡️ Challenge Rent in a Tribunal If landlords seek to increase rent via the statutory notice procedure, tenants can challenge the rent increase in a tribunal. However, they can only do so if they believe the proposed rent is above "market rent." This means the tribunal will assess whether the rent increase is fair compared to similar properties in the area. ➡️ Challenge Rent Review Clauses If the lease has a rent review clause, tenants can challenge it if the clause breaches the unfair terms rules. For example, if the clause allows the landlord an unfettered right to increase the rent to whatever they want. But best to seek legal adivce first. Here's my takeaway: Tenants have limited options due to Section 21 - which is due to be abolished under this government. If abolished, tenants will have more bargaining power when negotiating rent increases.
