This case highlights the dangers of an IP strategy that focusses too much in any one area of protection. Tesla have made it clear that patents are not their thing, saying they favour first mover advantage and better products (in reality, trade secrets) to keep their advantage on the market. In my view, an IP strategy that incorporates patents, designs, trade marks, trade secrets, copyright, etc, in a way that is appropriately balanced for the business is key. #IPStrategy #Patents #Tradesecrets #Tesla

An interesting exploration of IP strategies and conflict in the EV battery sector from my colleague Dustin Bauer. As with many things, the strength of an IP strategy can often be found in diversity, with over-reliance on one type of IP being detrimental to the strategy as a whole - patents, designs, trade secrets, and trade marks all play their part in developing a robust strategy. This is no more apparent than in the case of trade secrets. It may seem simple (I just have to not tell anyone outside the company, right?), but the reality is that concerted effort is required to define the trade secret and to ensure that access to the information is appropriately controlled. When "in-the-know" employees leave, it can be difficult for each party to objectively demarcate trade secrets and employee know-how. And where collaboration with a third-party is involved, the waters can get even murkier. As more decisions are issued from the UPC, Lucy Coe examines how two cases invoving Tesla shed light on the claim interpretation approach the court is taking. The following quote from the NanoString/10X Genomics apepal case forms the cornerstone of this approach: “The patent claim is not only the starting point, but the decisive basis for determining the scope of protection of a European patent. The interpretation of a patent claim does not depend solely on its exact wording in the linguistic sense…Rather, the description and the drawings must always be used as explanatory aids for the interpretation of the patent claim and not only to resolve any ambiguities in the patent claim”.

The question as to how much emphasis should be placed on the description when interpreting claims is one I keep coming up against in opposition proceedings, so it's interesting to read more about how the UPC are approaching this.
