I say no to leaseholders bailing out a rotten construction industry because the government wants to protect the construction industry. Labour's suggestion of non qualifying leaseholders having prepayment plans to pay for defective building remediation is abhorrent. The Tories constant refusal to protect all leaseholders from ruinous remediation costs is equally abhorrent. Both parties are wide off the mark. Under paragraph 8 of Schedule 8 to the Building Safety Act 2022, no service charge is payable under a qualifying lease in respect of cladding remediation, meaning the removal or replacement of any part of a cladding system that forms the outer wall of an external wall system and is unsafe. Handing down judgment on 17 May 2024 in Lehner v Lant Street Management Company Limited [2024] UKUT 0135 (LC), The Upper Tribunal allowed Mr Lehner’s appeal and in doing so rejected the FTT’s narrow interpretation of “cladding system” for the purposes of paragraph 8(2). The judgment interpreted cladding systems to include insulation sheets and cavity barriers. The "outer wall of an external wall system" is not limited to just the outer-most layer of the cladding system. Though not unexpected, the judgment confirms the UT's use of a wider interpretation of cladding system, providing wider protection for leaseholders.
