On #ThisDayInHistory, the US government passed the Communications Act of 1934, which combined and organized federal regulation of telephone, telegraph, and radio communications and created the Federal Communications Commission. The FCC plays an important role in what we do here at RDG, particularly when it comes to RF communication. #innovation #science #engineering

Here's a link to my paper published today on why the FCC's impending classification of broadband as a telecommunications service and application of utility-style regulation could be overturned in a major questions doctrine appeal to the Supreme Court. A lot could happen between now and then, but I thought it worth the look. https://lnkd.in/ekgNanD8

This is part 2 and comes with a report -- PDF. We believe it is not OK for a government agency to have advisory committees that are made up of the industry players-- and their associations, and many nonprofits that receive money from the industry. Simply put, when the votes come done or the working papers are complete, the industry used its influence and financial clout --- with the intent to create public policies that harm the public, more than help. And with the current $150 billion on the table being given out, including $42 billion for BEAD, is it any wonder that the companies will be getting a large sum of the money. -- and NOT solving the Digital Divide. And all of the companies-- wireline, wireless, broadband, internet, cable TV and phone are all holding hands and not competing. Part 1 and 2 document a cursory look at the flows of money on the FCC diversity council..

The European Commission today published a so-called White Paper in which it proposes a new approach to building Digital Infrastructure in Europe. At the same time, public consultations on regulatory changes and leveling the playing field have been launched. It is safe to say that the current policy of the European Union will unfortunately result in the fact that we will not achieve the goals in the digital decade. This is not possible in the current legal order, hence it is good that the Commission is making an attempt to change it and fill the investment gap of more than 174 billion euros. ICYMI: The European Commission has published the responses to its “How to master Europe’s digital infrastructure needs?” white paper, issued in April. The white paper represents the priorities of the outgoing European Commission, which may soon change following the re-election of Ursula von der Leyen as its president. Still, the white paper and its responses will likely inform the Commission’s future priorities. As we reported previously, the section on spectrum policy includes several polarizing ideas, such as a proposal that 6G auction timings should be harmonised across the European Union and that 3G switch-off should be coordinated across Member States. Some of those who responded to the European Commission's consultation on its digital infrastructure white paper thought it focused on the right problems, but many felt it proposed the wrong solutions. https://lnkd.in/eNywb5-V
