My wife, Kundi Ramashia-Dube who is a family law practioner, recently returned to work after maternity leave. I cannot imagine a world where she would have had to share any part of her maternity leave with me. As you may recall, there was a High Court judgment delivered in October last year which may change the maternity leave benefits contained in the BCEA, among others, and which provides that as interim measure, parents are entitled to 4 months' parental leave between the two of them. Whilst I appreciate the judgment for calling out discrimination against fathers, among others, it certainly did not properly consider the importance of affording women that minimum 4 month period post partum. In respect of my wife and I, it was incumbent for my wife to take this time out and I appreciate each sacrifice made. 10 days' parental leave would have also not been sufficient for me. In my view, the only way around this is to afford each parent 4 months' parental leave and allow each parent, based on their family needs, to decide how much parental leave they are taking. Of course this would have an impact on employers and policies would require review and amendment. *Please note that the Court's declaration of invalidity in respect of certain provisions in the BCEA is of no force and effect until confirmed by the Constitutional Court.* #employmentlaw #maternityleave #parentalleave #familylaw

Reflecting on a Recent Family Court Case I had the privilege to review the case Re X (Parental Responsibility) [2024] Fam Ct during my recent mini-pupillage, a matter that delved into the delicate balance between parental rights and a child’s welfare. Facts of the Case: The dispute involved a father seeking parental responsibility after years of absence. The mother opposed the application, arguing that granting such responsibility could destabilize the child’s emotional well-being due to the father’s past absence and history of tension within the family. Court’s Decision: The Family Court dismissed the father’s application, emphasizing that parental responsibility must always align with the child’s welfare. While the court acknowledged the father’s intentions, it determined that granting responsibility in this context was not in the child’s best interests. Why This Case Is Significant: This case highlights the evolving nature of family law, particularly the court’s unwavering focus on the welfare principle as the cornerstone of decision-making. It also underscores the importance of considering emotional stability when determining parental rights. Reviewing this case during my mini-pupillage was invaluable, as it reinforced the nuanced and empathetic approach required in family law. It also deepened my commitment to pursuing a career at the Bar, where I aim to contribute meaningfully to cases that impact lives so profoundly. #legal_rights_of_leaves_for_women My work in the field of law has made me convinced that what is more dangerous than a lack of #legal_awareness is a misunderstanding of the law. I was surprised by an employee who was forced to return to work only two weeks after she gave birth, under the pretext that she had completed her leave period because she had begun maternity leave three weeks before the birth, and thus (according to her line manager’s claim) that she had completed the six-week period prescribed for maternity leave. All I had to do was rely on the #labor_law, which stipulates that six weeks is the obligatory period of maternity leave immediately after birth, in order to restore her full health. But that is not all, it is out of a period of fourteen weeks, and this total legal period is no less than that, also it could be two more weeks off if she had a twin. I immediately extended her leave while directing a strong rebuke to her line manager and directing him to conduct an in-depth study of the #Libyan_labor_law, especially the #right_of_leaves_for_women.
