Last Thurs, FERC rejected a rehearing request challenging the extension order for MVP Southgate, which argued Mountain Valley’s contemplation of a redesign constituted project abandonment and that the Commission needed to assess whether the redesigned project was required by the public convenience and necessity. The Commission explained that because Mountain Valley had not yet submitted an application to amend the project, the details were speculative, and that MVP still holds precedent agreements for the original project, validating its determinations on project need and environmental analysis. #FERC noted that it is not out of the ordinary for project sponsors to amend certificated projects, and that if an application to amend Southgate were filed, staff would evaluate its environmental impacts and the need for the revised project. Minnesota’s environmental permitting process has long-been the topic of concern among business leaders. The Minnesota Chamber Foundation, the nonpartisan research arm of the Minnesota Chamber of Commerce, recently released a report that examined Minnesota’s air, water and wetland permitting process, along with environmental review. Here are our key takeaways: 1️⃣ Permitting timelines affects the state’s economy. 2️⃣ Minnesota would achieve meaningful economic gains if permit issuance timeframes were similar to peer states—measured by economic activity, household income and full-time jobs. 3️⃣ We can streamline the process without changing the standards.
