Safer Gambling Standards Development, Assessment and Consulting

The following judgement in India could be of interest to anyone that believes skill-based gaming could be a safer form of gambling. However, in many global jurisdictions where online gambling is allowed and/or licensed, you can't blame online gambling/gaming businesses continuing to focus on producing purely chance-based games such as slots, even though these games could cause more harm to some players, as such games are much more likely to generate greater revenues than skill-based games. So: - Will gaming regulators/governments throughout the world eventually recognise that treating real money games of skill in the same way as games of chance (just because they contain RNGs/elements of chance) be counter-productive in terms of reducing gambling harms? - Could online gaming companies at least offer skill-based games as a safer alternative for their customers? Big win for skill-based games in India! 🎉 The Allahabad High Court recently ruled that poker and rummy are games of skill, not gambling. The court emphasized that any denial of permission for recreational gaming activities must be substantiated by concrete facts rather than mere conjecture. This landmark decision reinforces the importance of differentiating skill-based gaming from games of chance, potentially shaping the future of India's gaming industry. ‘Games of Skill’ are legitimate business activities protected under Article 19(1)(g) of the Indian Constitution as per the rulings of the Supreme Court and several High Courts till date. These rulings have also emphasized a clear distinction between “Games of Skill” and “Games of Chance.” This significant ruling not only clarifies the legal status of poker as a skill-based game in India but also reinforces the importance of evidence-based decision-making in regulatory matters. E-Gaming Federation welcomes this progressive judgment and believes it will further strengthen the legal framework around skill-based gaming in India.
