In the latest Issue of Legal Transformation in Muslim Societies, Prof Mouez Khalfaoui in his article entitled 'Future of Shari’ah in Muslim Majority States and Beyond: A Critical Overview of the Recent Literature' argues that Shari’ah is presently applied selectively in both Muslim and non-Muslim states, with only a small number of Muslim states viewing it as a comprehensive legal system. Regarding the future of Shari’ah, two primary discourses are currently under discussion by scholars: a) either Shari’ah law will evolve and incorporate modern legal concepts to maintain its legitimacy; or b) it may stagnate and further weaken, potentially facing the risk of obsolescence. While the notion of Shari’ah stabilizing and remaining unchanged as an immutable legal system still persists, it represents a minority position amidst ongoing debates. #publication #shariah #sharia #law #Islamiclaw #muslimstates #islam #islamicstudies

It is always pleasant to discover that the essence of your work has been fully grasped by a reader: a fortiori, this applies when it comes to checking a review to one’s book. Rana Moustafa Essawy's review of my volume ‘Religion and Contract Law in Islam’ testifies to her interest to the subject. It also highlights the peculiar content and style of my investigation – or better, of the journey that I undertook in my search on the ‘aqd. “Valentino Cattelan’s new book, ‘Religion and Contract Law in Islam’, stands out as a unique account of the nature of the contract (ʿaqd) in Islam through an examination of the interaction between law and religion. […] [It] stands out not only for its subject matter but also for its distinct approach to address the topic. Cattelan’s prose takes a thought-provoking, story-telling approach, depicting the ʿaqd as a city that has stories to be told. In telling those stories, Cattelan uses unconventional techniques — relying on accounts that consist of a mixture of art, poetry, metaphors, and movies — which contribute significantly to the stories’ comprehension by a wider audience.” I definitely hope that the book will make the Islamic contract attractive beyond the small circle of legal scholars - because the ‘aqd has certainly many stories to tell about Islam, but also about the West.
