Can victims of sexual harassment choose to stay anonymous? A recent decision in the Hong Kong District Court sets out the legal principles to be applied in the granting of Anonymity Orders in sexual harassment cases. In this case, the Respondent’s application to set aside an Anonymity Order in favour of the Claimant was granted, sending a clear message that anonymity in sexual harassment claims is not automatic and must be properly obtained. The decision in February 2024 not to suspend Eastern Cape judge president Selby Mbenenge amidst sexual harassment allegations highlights the urgent need for a stronger stance against sexual harassment misconduct within court buildings. Allowing Mbenenge to evade consequences risks undermining trust in the judiciary and perpetuating a culture of impunity. It's essential to hold individuals in positions of authority accountable for their actions and ensure a safe environment for all. We need to put measures in place to uphold the integrity of the judiciary and demonstrate a commitment to addressing sexual harassment. In a thought-provoking article by the ABC, it was suggested that NDAs should not be used for sexual harassment claims where a company has agreed to payout the victim. Surely the focus should be on protecting the victim, not the perpetrator nor the organisation involved. If the perpetrator is seen as having a case to answer, surely the police should be involved.
