It was a pleasure moderating last weeks maiden joint event of NL VYAP | Netherlands Very Young Arbitration Practitioners and the below 40 group of the Netherlands Arbitration Institute (NAI) ("NAI Jong Oranje") on the hot topic of independence and impartiality in arbitration. 🎤Together with Matthew Brown and Irina Buga we – inter alia – discussed: 👉The importance of independence and impartiality of arbitrators in arbitral proceedings 👉Tricky distinctions (i.e. the standard to be applied with regard to challenge and disclosure and in different type of arbitrations, e.g. international vs. investment arbitration) 👉Recent trends (i.e. new IBA Guidelines on the conflict of interests 2024 and the new NAI Rules 2024, under which unjustified challenges can be sanctioned by the abitral tribunal by denying further challenges) 👉Considerations to be made by the parties / counsel when selecting arbitrator(s) and deciding to challenge them 👉What to disclose if you are selected as arbitrator If you have questions or want to exchange thoughts please let me know. #24 – Luis Figarella: The Fourth F is for Figarella Luis is patent agent, originally from Puerto Rico and enjoying a Puerto Rican beer. Wanted to be a fighter pilot but stopped by bad eyes. Became an electrical engineer instead. Remember when resumes were actually mailed? In late 80s, worked for UPS on automated truck loading. Early in his career, he didn’t even know what a patent was. Learned his first patent had issued because he received an offer to make a plaque of it. Patent descriptions are like painting by numbers. It is an important decision on what to patent. Learned that Florida is hotter than Puerto Rico. A little on patent agent vs. attorney. Claim writing is an art form. And a very important one. Strategic patent – what you want to make. Tactical patent – similar to what you want to make. Luis is a big Dilbert fan. Loves teaching people what patents are. Most clients are in the FFF round – friends, family, and fools. To grow the Sports Industry and cost efficiently resolve sports-related disputes in HKSAR and the rest of APAC, we can rely on AALCO Hong Kong Regional Arbitration Centre for fair and speedy mediation and arbitration Mr. Edgar Yang, PDSM, the Honorary Secretary General of the Sports Federation & Olympic Committee of Hong Kong, China (“SF&OC”), pointed out that Hong Kong has a sound and robust legal framework, but the courts are not always the most time and cost efficient forum for resolving sports-related disputes. Recent collaborations with the AALCO Hong Kong Regional Arbitration Centre (“AALCO-HKRAC”) has yielded great positive results using alternative disputes resolution (ADR) to help resolve sports-related disputes through fair, creative and just means that are welcomed by all parties. AALCO-HKRAC is widely recognized as a reliable and neutral institution for dispute resolution. Mr. Edgar Yang emphasized that this collaboration would enable the 80+ sports associations under the SF&OC to efficiently address and resolve complex legal issues and achieve the goals of harmony and mutually beneficial outcomes when dealing with sports related disputes through mediation and arbitration. The Honourable Duncan Chiu, the Member of Legislative Council and the Chairman of Squash Association of Hong Kong, China, also highlighted that many sports associations are presently unfamiliar with the processes and availability of mediation and arbitration to resolve disputes. As these sports associations and important stakeholders often rely on government and philanthropic funding, they are not able to bear the high costs associated with court litigation. The development of cost-efficient sports mediation and arbitration mechanisms in Hong Kong is an urgent necessity. With its abundance of professional and experts, Hong Kong has the potential to establish high standards of service that not only meet the needs of the local sports community but also for Mainland China and even globally. This will further strengthen Hong Kong’s position as an international legal and dispute resolution hub. #aalco #arbitration #mediation #sportarbitration #odr #adr

This led to the development of experiential learning approaches that emphasised hands-on activities and problem-solving skills. 👔We are now at an era of the “no collar worker” where we need to be creative, critical, problem solvers, hands on and a jack of all trades… in addition STEAM jobs by 2030 will make up 80% of jobs in the UK due to the #Sustainability requirements of the world. How do you teach and inspire STEAM learning and interdisciplinary learning?
