By-Laws are the set of specific rules that each Body Corporate makes to help regulate what owners and occupiers can or can’t do with their home or on the common property. By-Laws registered with Titles Queensland must be enforced by the Body Corporate. When you have evidence that someone is breaching the by-laws, you can ask the Body Corporate to get involved. A Body Corporate is responsible for enforcing its own By-Laws. Owners and occupiers can also take action to enforce the By-Laws. When an owner or occupier is in breach of the By-Laws, we suggest by beginning with an informal approach to resolve the issue. If informal resolution is not successful, the first formal step to give a By-Law Contravention Notice to the person in breach of the By-Laws. The decision to give a By-Law Contravention Notice can be made by the Committee, or the Body Corporate at a General Meeting. If the matter persists following the Contravention Notice, an application for conciliation can be made with the Office of the Commissioner for Body Corporate and Community Management. A historical undercover investigation by Housing Rights Initiative found rampant discrimination & clear violations of the law by real estate companies against families with Section 8 vouchers. This is the largest largest housing discrimination case in California’s history, against 203 real estate agents, brokerage firms and landlords, including some of the largest real estate companies in the country: Coldwell Banker, EXP Realty, Sotheby's International Realty, and RE/MAX.
