Compliance in international and domestic trade is crucial. The Type 86 Pilot Program brought many freight forwarders success in the 321 import de minimis arena, but CBP is now tightening regulations. Recent changes under the program effective February 15, 2024, are particularly noteworthy amidst the surge of cross-border and air cargo e-commerce. Online merchants selling to US customers, as well as their customs brokers, got an unexpected reprieve last month from the U.S. Customs and Border Protection, which postponed a mandate for advance submission of shipment data. On 13 April, the CBP was poised to implement a mandate for advance submission of data for Section 321 Type 86 shipments that fall under the de minimis exemption on duties. However, shortly before the new regime was set to kick in, CBP postponed the implementation date, and has not yet given a new implementation date. But a squeeze is still looming, notably for Chinese sellers.... Several bills are before Congress, which are taking aim at shipments below the de minimis threshold of $800 for US consumers. I started my career in import/export, met David Strom at my next stop, and await eagerly each issue of his Web Informant blog. He again brings us a glimpse into an unexpected topic: US Customs and Border Protection and new emphasis on ensuring small packages entering the country via airfreight are compliant with US customs law. Interesting to consider that consolidated maritime shipments could actually become more of the norm - and potentially as expensive or more expensive downstream to the customer as airfreight. U.S. Customs and Border Protection has suspended multiple brokers from an expedited clearance program for duty-free imports, including packages from China-linked companies like Shein and Temu.
