Just ten days ago, Déborah Melo and I were chatting about the EU Deforestation Regulation (EUDR), which is on the top of the agenda of many EU and foreign producers that areaffected by the new far-reaching deforestation due diligence requirements. Since the European Commission proposed to postpone the implementation of the EUDR by one year, one of the main questions was whether any substantive amendments will be tabled either by the Council or by the European Parliament. Last week, the EPP group, which is the largest political group in the Parliament, put forward a set of important additional amendments to the EUDR. In particular, it proposed to: - postpone the implementation of the EUDR by two years, i.e. till the end of 2026; - introduce an additional risk category in the country benchmarking - "no risk" (used interchangeably with "insignificant risk"); - ensure at least a 6-months period between the publication of the risk classification and the start of the implementation; - exempt traders from the EUDR obligations. The classification of a country/parts thereof as having no/insignificant risk will depend on several criteria: (i) stable or increased forest area since 1990; (ii) signatory to the Paris Agreement and international conventions on human rights and deforestation; (iii) transparent and monitored implementation/enforcement at the national level of regulations as regards deforestation and forest conservation. Practically speaking, covered products originating in no/insignificant risk country/parts thereof will be exempted from due diligence requirements, but will need to comply with the legality requirement and new documentation requirements. Only 0.1% of operators placing/making available such products on the market will be subject to checks by competent national authorities in the EU. The European Parliament will vote on the proposed amendments this Thursday, 14 November. Stay tuned for more updates! Many thanks to Women Inside Trade and Deborah for inviting me.
