I'm currently writing a paper on the prevention of Intimate Partner Violence as a method of reducing women's criminality. The numbers demonstrate that a staggering number of offenders have experienced victimization in their life. Where we can stop the IPV victimization of a woman, we not only stop that individual from experiencing harm, but there are cascading effects: We save a woman from harm in that domestic context AND may be helping her to avoid subsequent life experiences that leave her vulnerable to criminality. We save children from living in homes fraught with abuse, and help promote healthier relationships in future generations. We prevent criminal behaviour of victimized individuals that may victimize others. And this is not even accounting for the impact that the prevention method can have - because those prevention strategies have to address social issues that lead to IPV in the first place. Preventing IPV because we want to protect someone from abuse is enough of a reason all on its own to justify action. But it isn't the only positive result, which makes it even more beneficial. This is what we need, and I'm excited to see how things go.
Progress on redressing and preventing #IPV requires a society-wide response and epidemic-level funding and intervention measures aimed at unrooting women’s legal, social, and financial disadvantages that have maintained men’s advantage and control over women and bar them from achieving substantive equality. DOES THE LAW WORK DIFFERENTLY FOR DIFFERENT GENDERS? I recollect, a few years ago, while assisting Mohsina Ahmed with some novice legal advice (as a law student) for a counseling case, I was bewildered when I failed to find an answer as to how to help a man facing domestic violence. He was not crying, but was sobbing. When a man sobs, there is definitely something horrendous going on. Besides, he refused to even file any sort of a police complaint as he felt he would become a laughing stock for the society. Keeping this in mind, I later realized that the society has a good number of people fighting for women's rights, but a handful fighting for the rights of men. I tried raising this issue and elaborating on these lines in my dissertation during the LL.M course at NLS, wherein I wrote regarding the pressing need for gender neutrality in rape and sexual assault laws. [Link: https://lnkd.in/gEPQRy3p ] Today, there are ample cases when the law is being used as a means to oppress men. The recent demise of Mr. Atul Subhash is one such occasion. I can confidently state that there are many such Atul Subhash living silently in our society. Before we lose any of them, we need change. Law being used as a means to harass and oppress men is not only violative of their legal rights, but also violative of their constitutional rights under Articles 14, 19 and 21 of the Indian Constitution. At the heart of transformative constitutionalism, is a recognition of change. Change has to be recognized as an essential facet of a democracy. The law cannot cling on to the past and be expected to deliver justice in the present. To keep pace with today, certain loopholes in the law, which was framed yesterday must be identified, analyzed and corrected for a better today and tomorrow. The Indian Parliament must pay attention to injustice meted out to men and introduce amends to the law so that equality prevails, in the real sense. To conclude, a wise man once said - "Injustice anywhere is a threat to justice everywhere." #Change #GenderJustice #Law #Equality #Society

On this #HumanRightsDay, the BILQIS Project reflects on the urgent need to uphold human rights in the face of ongoing challenges and injustices across the world. This year’s theme, “Our Rights, Our Future,” highlights the importance of inclusive justice systems in shaping a world where everyone can thrive. At BILQIS, we focus on advancing Muslim women’s access to justice in Europe, exploring how they navigate questions of agency and authority across historical and contemporary contexts. By examining the development of Islamic family laws (IFL) and their intersections with state structures, our work seeks to address critical barriers to justice. Human Rights Day reminds us that achieving justice requires reimagining legal frameworks to be inclusive of diverse lived experiences. At BILQIS, we remain committed to fostering a future where justice is accessible to all, grounded in respect for agency, equity, and human dignity. Join the conversation: How can we work together to ensure justice systems are truly inclusive and equitable? #HumanRightsDay2024 #OurRightsOurFuture #BILQISProject #JusticeForAll #HumanRights Irish Centre for Human Rights at University of Galway https://lnkd.in/e47R-2Hd Photo by Markus Spiske on Unsplash
