Pleased to contribute to this article for ComputerWeekly.com highlighting how the disproportionate impact of the Employers NIC increase for umbrella company employees could be the trigger for a reset in the market and a move back towards genuinely outside IR35 contracts. There is more risk and cost coming for "inside IR35" contracts - Employers NIC rise / Employment Rights Bill / Umbrella Regulation - could these factors be the trigger for a relaxation in risk based blanket bans on PSCs or blanket inside-IR35 determinations? Keen to hear people's thoughts on this. https://lnkd.in/exFnRxg2
Unfortunately IR35 "Blanket Bans" and blanket "Inside Only" determinations are still rife across some industries, as Clients are just not willing to take the time and effort to do proper individual IR35 status determinations. However, Labour's budget and their proposals around "Single Worker Status" might change that.
Matt Fryer I think this article is broadly correct in that for those wishing it otherwise there is unlikely to be a wholesale rush to outside contractors, though there may indeed be some more realistic SDS assessments. As for the impact on those working inside, they are going to be worse off, but based upon an analysis I have seen from Lucy Smith, backed up by my own calculations (based upon my actual 2023 accounts) this amounts to £3-4 per billable day - so basically the cost of a coffee, so a manageable impact.
