When airlines fail you, the passenger, what are your rights? As an independent travel agent of close on to 41 years experience, I have seen a lot of things and noted with due diligence, the number of times an airline will deny a passenger boarding, simply because they have overbooked the plane. It’s a well-known fact that airlines regularly overbook flights, and will not hesitate to inconvenience passengers with little or no regard to their rights. In my humble opinion it’s immoral and totally unfair, especially on people who have booked many months in advance, using their hard earned money to do so. Equally, those travelling on business have my sympathies too, as all too often they are on a tight schedule, and delays will impact that. The practise of overbooking should be outlawed. After all, if you have a plane with 200 seats, then 200 is all you can sell. You can’t double sell a seat, knowing that two people will share a seat. That’s against every safety rule going. An airline will retort by saying that it effects their profits. Whilst I understand certain things, this is illogical. Many airlines have so many non refundable tickets, only the most expensive can be changed freely, and without charge. I’ve had clients who have had to cancel for a variety of reasons, but get no refund from the airline. However, the airline then puts them back on sale, sells them and collects the fare twice, or more if the same thing happens again and again. Therefore, seeing carriers are getting their money, sometimes many times over, is no excuse to this practise. I therefore urge people to be aware of their passenger rights BEFORE they travel, so they are aware of what they can legally claim for and expect. The most common is the UK 261 legislation, which stems from the EU 261 variation when the UK left European. It’s pretty much identical. 🛫 The European Commission approved Revised Interpretative Guidelines on Regulation 261/2004 on 22 July 2024. These have been created to reflect new court rulings after the previous version from 2016. Since there have been many myths about the regulation, even among industry thought leaders, this is an important step in passenger protection. It brings more clarity and more decision-backed examples. In my experience, airlines are mainly violating Article 8 of the regulation, by limiting your options in case of cancellations (regardless of the time frame). This impacts passengers the most, often leading to forced refunds and unnecessary cost for you as a passenger. I believe it’s for the first time we see a clear statement that even travel agency ticket retains the air carrier’s obligation to assist passengers. Finally - the airline must help you, not the travel agency. We now also have a clear statement that rerouting must not exclude other airlines, no matter any alliance membership, as long as the scheduled arrival time of the alternative flight is earlier than the one of the next flight of the air carrier concerned. Finally - and take screenshots of seats on sale if needed. There is lots of valuable information and it’s great to see such update. 💡
