Generative AI and Copyright: EU Explores Legislative Gaps Luca Bertuzzi reports that EU governments have begun discussions on generative AI and copyright, driven by a comprehensive questionnaire addressing reservation rights, AI-generated content protection, and potential liability regimes for copyright infringements. This initiative aims to inspire new EU policies as the new European Commission takes office. With critical issues yet to be discussed, Hungary has spearheaded this effort to shape future debates. Key dates include substantive discussions on Sept. 20 and Oct. 15, with a stocktaking paper due on Dec. 11. This development could provide much-needed legal certainty and help balance the economic interests of various stakeholders. By addressing reservation rights and liability regimes, the EU aims to clarify the legal framework, encouraging innovation while protecting intellectual property rights. I've been on vacation, so I am late posting my comments on the 7th Circuit's approach on copyright's predicate act doctrine for extraterritorial damages as decided in Motorola Solutions, Inc. v. Hytera Communications Corp. The case also involves the extraterritorial application of the Defend Trade Secrets Act. IT is a long, complicated decision, but it is also an important one. My basic take on the predicate act doctrine: the 7th Circuit should have revisited the predicate act doctrine and assess its consistency with WesternGeco (arguably consistent) and Abitron (seemingly in tension).
