Understanding Redundancy vs. Other forms of dismissal I often encounter a common misconception that when businesses face the need to downsize, the focus often shifts to individuals rather than roles. Let's set the record straight! When we talk about redundancy, it's the position, not the person, that's being made redundant. If the intention is to part ways with a specific individual, it may indicate that redundancy isn't the appropriate route or a genuine and fair reason for dismissal If you're uncertain about the Redundancy process or need guidance tailored to your unique situation, let's chat. I'm here to provide practical advice and support for business owners. Call me on 0115 822 4847 or visit https://bit.ly/3Kn6HtY #redundancy #management #HR #SME

Why every UK start-up and small business needs a professionally written Employment Contract for your business from a HR Consultant. Starting a business is an exciting journey, but it comes with its own set of challenges. One crucial aspect that often gets overlooked is the importance of having a professionally written employment contract. So why should you consider consulting a HR expert for this vital document: 1. Legal Compliance Employment laws in the UK are complex and constantly evolving. A HR consultant ensures your contracts are up-to-date and compliant with current legislation, reducing the risk of legal disputes. 2. Clarity and Transparency A well-drafted contract clearly outlines the roles, responsibilities, and expectations for both parties. This transparency helps in building trust and sets a solid foundation for a positive working relationship. 3. Protecting Your Business From confidentiality clauses to non-compete agreements, a professional contract can safeguard your business interests and intellectual property. 4. Employee Satisfaction Clear terms and conditions can enhance job satisfaction and retention. Employees are more likely to stay with a company that values transparency and fairness. 5. Professionalism A professionally written contract reflects the seriousness and professionalism of your business, making it more attractive to potential employees and investors. Investing in a professional employment contract is not just a legal necessity but a strategic move to ensure the smooth operation and growth of your business and costs just £300. Don’t leave it to chance, email me today to discuss your employment contracts [email protected] #SmallBusiness #Startup #HR #EmploymentLaw #BusinessGrowth #HRConsultant

What is the Difference Between an HR Consultant and an Employment Lawyer? This is a common question that I’m asked. While both roles are essential in supporting businesses and employees, their focus and expertise are distinct. HR consultants prioritise operational and cultural improvements to prevent problems, while employment lawyers address legal conflicts and provide support during disputes. 🔹 HR Consultant Expertise HR consultants are specialists in workplace operations, culture, and compliance. Their role is typically proactive, helping businesses design and implement HR policies, manage recruitment, improve employee engagement, and ensure compliance with labour regulations. They provide strategies to prevent issues before they arise and are often involved in organisational development, training, and strategic workforce planning. Think of an HR consultant as a partner focused on creating and maintaining a productive and positive workplace. 🔹 Employment Lawyer An employment lawyer focuses on the legal side of workplace issues. They step in when there’s a dispute, such as wrongful termination claims, harassment allegations, or contract disputes. Employment lawyers provide legal advice, represent clients in court, and ensure compliance with the UK employment laws. If you’re facing a legal challenge or need expert guidance on risk mitigation, an employment lawyer is your go-to. Both roles are valuable and often complementary. I often collaborate with employment lawyers and I support with investigations. Many businesses benefit from having a trusted HR consultant to establish strong practices and an employment lawyer to handle complex legal matters when they arise. #HRConsulting #EmploymentLaw #WorkplaceSupport #BusinessSuccess #employmentlawyer #HRconsultant

So after a thought provoking session at the East Lancashire Chamber of Commerce & Forbes Solicitors HR Forum. I needed to time to reflect, so we went for a team walk up Pendle Hill, ok I say team, its was me and my dog Lola. I was mainly struck by the reactions of an audience largely made up of HR practitioners to the behaviours of an alleged 'sexual harasser' in the role play scenario. HR is a community that attracts all personality types and value sets and it was clear that some felt that the punishment should be severe and trusted the investigation process to clarify the 'facts'. In my experience the world is not quite as cut and dried, evidence is often tainted itself by each individuals perspective. Our perception of an event is not necessarily the event itself. A thorough investigation is only that start, deciding whether there is case to answer. Making the decision on any potential sanction is the organisations role and an even tougher one, again the role of HR is to be the guardian of values and culture in that decision making process. 'Reasonable grounds' remains a key element in employment law as does 'natural justice'. Doing things right and doing the right thing are not the same. Investigations should be as 'independent' as possible and in most tough cases I have brought in an outside third party to carry them out. In my experience it is a skill that not many people possess and knowledge of the individuals doesn't always help in selecting investigation leads and yes I know it a luxury not many organisations can afford. So our thoughts as the sun went down over Pendle were the same as always, try to dial down the judgement, be clear on what your purpose is and remember, every decision is correct, at the time that you make it! Well Lola just thought, dad can we go home now? I'm tired and we did a big walk at the weekend...

Here's a true story about luck. It is often said that luck is the intersection of preparation and opportunity. If that is the case, HRC Law is a perfect example of luck. 𝙏𝙝𝙚 𝙊𝙥𝙥𝙤𝙧𝙩𝙪𝙣𝙞𝙩𝙮 In 2022, I received an email from a sales rep at HR Covered Inc. offering my law firm D2Law LLP HR services. I could have ignored the email or simply replied that I wasn't interested. Instead, I saw the email as an opportunity. I replied that as an employment lawyer, I did not need HR services, but, I had an idea that I wanted to discuss with one of their executives. I didn't expect to receive a reply, but, I thought it was worth a shot. To my surprise, a week or two later, I received a reply from the Chief Growth Officer at HR Covered Inc. 𝙏𝙝𝙚 𝙋𝙧𝙚𝙥𝙖𝙧𝙖𝙩𝙞𝙤𝙣 I had been thinking about creating a law firm that would provide employment law services on a subscription basis to Canadian SMBs for quite some time. Unfortunately, I had no idea how to get it off the ground. So, when an HR Company that was already offering HR services to Canadian SMBs on a subscription basis came "knocking," I saw this as an amazing opportunity and because I had already developed my vision, I was prepared. 𝙏𝙝𝙚 𝙍𝙚𝙨𝙪𝙡𝙩 A few months later, after several discussions and lots of planning, HRC Law was born and we have not looked back since. I am grateful every day for the "luck" that led to its creation. We now have over 140 Canadian SMBs and not-for-profits as clients and I am amazed at what can be created in just a couple of years. 𝙏𝙝𝙚 𝙁𝙪𝙩𝙪𝙧𝙚 That being said, I am far from satisfied - I want all eligible Canadian SMBs and not-for-profits to have access to our service or a service like ours because it is literally a cheat code for them allowing them to have 𝙐𝙉𝙇𝙄𝙈𝙄𝙏𝙀𝘿 expert advice at a fraction of the price. Because our advice is unlimited, we become our clients' trusted advisors and help them to make good decisions on workforce issues so that they can focus on their core business. If you would benefit from using our services please send me a message, or if you know someone who would benefit from using our services, please tag them in the comments!
