𝘐'𝘮 𝘢𝘧𝘳𝘢𝘪𝘥 𝘐 𝘢𝘮 𝘴𝘩𝘺𝘪𝘯𝘨 𝘢𝘵 𝘵𝘩𝘢𝘵 𝘧𝘦𝘯𝘤𝘦" Those who have been involved in litigation will recognise that this is exactly the effect of a Part 36 offer; in effect, it moves the parameters for a "win" for one party to require that party to beat the offer at trial. If the offer is not "beaten", the party receiving that offer can expect to bear costs consequences (including in some cases having to meet the other side's legal costs). It is easy to see why Grant feels miffed about this. Money is not something which Murdoch's empire has in short supply and therefore it has been able to shift the parameters for a "win" for Grant to put him at serious risk of "losing", even if he makes out all of his claims. However, there are very good reasons for the Part 36 offer regime, and Grant's case is perhaps a prime example of the benefits it offers. If a Defendant offers a Claimant everything that they are due in litigation, the dispute between the parties becomes academic. It's easy to see (in less emotive cases) why a Claimant should have to bear the Defendant's costs if (having been offered everything it was entitled to or more) it causes the parties (and the public purse) to incur further costs in a contested trial. Clearly, for Grant, the claim was about more than money and (whilst it is possible for a part 36 offer to include non-monetary terms) it appears that money is the only thing the Sun (& co) was willing to offer. I do not know whether Grant was also seeking non-monetary relief in his claim (such as a declaration that the Sun broke the law) and if he was it would be interesting to know whether a purely monetary offer without admission of liability would be sufficient to displace the burden in this case. Ultimately, a litigant whose primary goal is to be vindicated may have to find solace in receiving a chunk of money for their woes rather than having their day in Court.
A well timed, well thought out Part 36 Offer can deter even the most steadfast litigants. It is a tool at the disposal of those engaged in litigation and whatever your thoughts on either Hugh Grant (fantastic performance in The Gentlemen) or the red tops, it was clearly used to good effect here by one of the parties.
