CAN PRIVATE GARMENTS BE PRESENTED AS EVIDENCE IN COURT OF LAW? A very significant case called “Underwear Evidence tampering case” . As its name suggests let's dive into the dark side of this interesting case. The tale begins in April 1990 when an Australian man, named Andrew Salvatore Cervelli was arrested at the Thiruvananthapuram airport for allegedly smuggling 61.5 grams of hashish by concealing it in his underwear. There was soon a twist in the tale. When Cervelli approached the Kerala High Court in appeal against his conviction and sentence, it was found that the underwear in evidence was much too small to fit him, and smaller than the recorded size. The High Court acquitted Cervelli, who was represented then by a junior lawyer named Antony Raju. Not too long after he returned, he was arrested in Victoria on a murder charge. While in jail, he supposedly told other inmates about his escapades in India, especially a tale of how he managed to hoodwink Indian police and courts. The Australian National Central Bureau quickly informed the concerned Indian authorities that when Cervelli's co-accused in the murder case was being interviewed, he had revealed that Cervelli's family and lawyers had allegedly bribed a court official and either swapped or altered the underwear that was in evidence. Similarly, the underwear episode even made its way to the silver screen, with the exact story being retold in the 1991 movie Aanaval Mothiram, released a year after the incident. This case represents about the hidden dark side of justice where most of the evidences and witnesses are getting tampered easily. When it can be so easy for a foreigner then what about the citizens of the country!? I'm glad to share that I have completed my one-month litigation under AATRI LAW ASSOCIATES. This journey was a great learning experience, and I regularly assisted Adv. Ritesh Tanwar in legal research and, drafting. Following are the few things that I have worked on:- 1. Drafted an application under Order 6 rule 17 of CPC. 2. Observed Mediation proceedings at Patiala House Court. 3. Researched the validity of GPA/SA/Will as a legal instrument of transfer of property. 4. Cases against Sec.311 of CrPC. 5. Drafted an application for cancellation of Bail. 6. Observed chief and cross-examination of I.O. 7. Drafted legal notice. 8. Visited Badshahpur P.S. in Gurugram to lodge an FIR under Section 69 of BNS, 2023. Adv. Tanwar and Adv. Alkesh guided me on different aspects of litigation and the intricacies involved in it. Today at Gitarattan International Business School, Delhi our mediating team had to face extreme discomfort and blunderous issues which could have been dealt very smoothly but the OC committee of Justitia 4.0 ResolvaCon organising the mediation competition were reluctant to do so. The first issue what we faced was unresponsive and unaware behaviour of the OC members about the competition rules they themselves are conducting. Then at semi finals what we got to know is that beside the standard rule of promoting the mediating pair and mediator their own rules were followed and they were concluding marks of the above said entities together and then giving the result about they didn’t informed the participants earlier neither in the brochure or during the orientation. I and all the participants coming from various reputed law colleges have to face this issue despite spending a hefty amount of money on the registration form and also bearing the travel expense from various cities just to make it to the giBS, Rohini we were treated like nobodies. Also despite waiting for so long to come an amicable solution the result was NIL. The unfortunate incident deeply saddens me and the other participants as well and deep inside all the participants who have to face such issues should be getting the refund of the registration fees and reimbursement of the convence they used for the sake of the competition. As we all know that the Indian Judicial system is very expensive, most of the time, people try to resolve the matter through alternative methods such as arbitration, mediation, and negotiation. These methods are proposed and agreed upon only on the basis of legal notice A legal notice is a formal written communication between the parties. Through a legal notice, the sender notifies the recipient about his intention of undertaking legal proceedings against the latter. A legal notice also helps in making the receiving party aware of the grievances of the sender. It works as a last warning to the receiver to fulfil a certain condition if he does not want a court battle. Re-think about the following aspects about the legal profession in India: 1. Over-glamourised and sensationalised: Movies, TV shows, and social media often portray the legal profession as glamorous, with thrilling courtroom drama and a lavish lifestyle. While this may be true for a select few, the reality for most lawyers is much different—long hours spent drafting documents, dealing with procedural delays, and handling monotonous paperwork, with far less excitement than what’s shown on screen. 2. Burnout Risk: The profession often demands extended working hours, immense pressure from seniors, cutthroat competition, and emotional strain. This constant grind makes it difficult to maintain a healthy work-life balance and increases the risk of burnout over time. 3.
