3/8/24 - NLRB's final rule on joint employment has been vacated by a federal court in TX. The Final Rule would have made it easier for the NLRB to determine that two or more entities jointly employed the same workers under the National Labor Relations Act. NLRB released statement on 3/9/24 stating, in part, the "District Court’s decision to vacate the Board’s rule is a disappointing setback, but is not the last word on our efforts to return our joint-employer standard to the common law principles that have been endorsed by other courts ... Last week, the Supreme Court decided to overturn a long held doctrine of assigning judicial deference to administrative rules. This may sound like something that is only of concern to lawyers, but it's not. Federal regulations impact all of us on a daily basis. For employers, the U.S. Department of Labor regulations that have long guided decisions about how to treat and compensate employees are far more likely to be challenged and invalidated. As the impact of decision takes shape, employers should consult counsel before assuming they must follow or ignore Federal regulations and guidance and comply with State and local laws, which are not impacted by the decision. #employmentlaw #employmentlawyer #hrcompliance
