There is a total ban on mounting billboards at any location in the focus country. It's bizarre thinking about how minute this is but if done, it's actually illegal and criminal. In the wake of 11 September 2001, the USA and the UK led a war later that fall against Al-Qaeda and the Taliban. Thousands of captured Al-Qaeda and Taliban fighters were shipped to a prison facility at Guantánamo Bay. They were held without trial, and for an indefinite duration. Lord Steyn lamented that the prisoners found themselves without any legal protection, and so in “legal black holes.” Of course, there is nothing analogous in the situation at Guantánamo Bay and at McGill. But Guantánamo Bay is the origin of the legal concept of "legal grey hole." It is that concept that we retain here. President H. Deep Saini, Provost Christopher Manfredi and Vice-President Fabrice Labeau are attempting to draw AMPL and its members into a legal grey hole. AMPL went on strike 24 April 2024 after almost a year and a half of frustrating bargaining. Before the strike and during, we called on VP Labeau and his team to sit down with us urgently to settle a collective agreement. We were refused a meeting until 7 June 2024. During this same period, VP Labeau reached out almost weekly to seek meetings with pro-Palestinian protestors encamped on McGill’s lower campus, protestors President Saini referred to as “illegal occupiers.” Properly understood, VP Labeau’s request for arbitration is not a proper exercise of a statutory right, but rather an abuse of the same. The arbitration process VP Labeau is requesting is not intended to produce a collective agreement. Quite the contrary, the University’s plain intent is to guarantee the possibility of a decertification hearing that, if won by the University, would make a collective agreement all but impossible. Were this not the intent, the University would drop the decertification lawsuit.
