As we get firmly into October, here are a couple of things I am seeing in the lateral market: 🦋 Litigation is still hot-AmLaw and boutique. It depends on what you are looking for, but there are jobs for junior and mid-level litigators. There is also a lot of competition for the AmLaw roles. 🦋 Corporate roles, other than financing, are few and far between for the time being. I am hopeful that this changes soon, but we could be looking at Q1 before we see corporate opening up. 🦋 There are opportunities in real estate for more senior associates (think 5+ years). We are working on a few junior roles as well. 🦋 Labor & employment is also pretty hot. We are working on several roles right now! What this means for YOU if you are considering a lateral move? 🐛 It is never to soon the start the process. I am working with several stellar corporate attorneys, and we are bidding our time until there is some movement. 🐛 Most associates want to stay and receive their bonuses. It makes sense. The interview process, especially for AmLaw firms, is lengthy, so a Q1 start is totally doable. 🐛 Working with a recruiter (ME), I will watch the market for you, and identify opportunities as they come in--posted and unposted. If you're a litigator in Toronto, you're likely getting multiple calls from recruiters each week. You're seeing lots of opportunities (with top groups across the city), and it can be easy to brush them off because you expect more calls to come next week. But here's the thing, it won't say a litigators market forever. Just ask your corporate friends who were getting tons of calls in 2020/2021, but whose phones have been silent since. My unsolicited advice: Even if you're not looking to move... Even if you're happy where you're at... Even if you end up staying in your current role... You owe it to yourself to consider your options. As you get more senior and enter income/equity partnership it becomes more challenging to move – especially as a litigator – unless you have a book of business. If you want to stay in control of your career and set yourself up for long-term success, now is when you want to explore options and capitalize on the state of the market. Want to get noticed by more recruiters and firms? Update your firm bio. I see too many lawyers whose bios read someone along these lines: “Joe is an attorney in the complex litigation group.” There’s no information about Joe’s practice area, his experience, or his representative matters. Recruiters and firms find lawyers based on keywords in your firm bio. Joe would appear in every single litigation search, regardless of his specialty and expertise. Maybe Joe is a litigator who focuses on representing shareholders in derivative actions. No one, including recruiters, would know that based on Joe’s firm bio. And, more likely than not, Joe’s pleadings are not easily accessible to the public, so a discerning recruiter cannot search for Joe on Google to get a better understanding of what Joe does. With his scanty bio, Joe will get spammed by recruiters for every single litigation search in his region without actually being targeted for searches that would actually fit his experience and interests. An updated bio is a way for you to market yourself so recruiters and firms can approach you, rather than forcing you to go out and seek a recruiter or wait for a recruiter to reach out with an opportunity that aligns with your experience and preferences. It can also cut down on outreach you receive that is of no interest to you. In other words, it’s a way for you to solicit interesting opportunities passively. It behooves you to know what’s going on in the job market because things at your firm can change quickly and you may suddenly be looking for new opportunities. It’s better to understand what’s out there before that happens than to scramble once conditions change. Picture this: you are working with a fantastic, enviable partner, amazing practice, top credentials, and stellar personality. You excitedly submit the introduction to what also seems to be a perfect match of a firm only to get back: "We are not interested at this time." ⁉ Unfortunately, what is predictable is that recruiting can be unpredictable. What would you do? ❔ Plead, ❔ Probe, or ❔ Pivot I'll start. In my experience, it is critical to understand the Why in order to determine best next steps, so I jump to Probe. While I may not understand the firm's decision, I also realize I can't always control it. Yesterday, I was reminded of the art of making someone an offer and how it parallels life: you can't seem too eager. People want what feels just out of reach, not what comes too easily. That’s why when making an offer—especially if you're working with a recruiter—it's essential to strategize about how and when to present it. Offering a job within 45 minutes of meeting someone can be premature. Like everything in life, the timing and delivery can be just as important as the content itself. Speaking to a partner this morning I was reminded that the push and pull in legal recruiting can be a complex dynamic. Some attorneys are 'pushed' into the lateral market by disappointments while there is a subset who is 'pulled' into a process for only an exceptional opportunity. Regardless of the trigger, there can be a continuous ebb and flow. This partner started by telling me he was happy but keep him in mind if I had something extra special. 15 minutes in - we walked thru some major deal-breaker issues. By the end, we explored two firms and their business initiatives in his space (both exceptional) and how this may translate for him. Yes, he scheduled a follow up to continue the process. Consider these 4 Points: 🔹 The Silent Majority: Even when it keeps them up at night, many attorneys won’t immediately discuss challenges. “I am happy” shouldn’t stop you from asking the hard questions. 🔹 Mapping: Identify your firm's solutions for a target candidates' hurdles, provide a roadmap for ambassadors to position them for success. 🔹 Helicopter View: Understanding the bigger picture is key. Start with the firm's business initiatives and vision (Often the strongest selling point!) follow with the specific opportunity/value prop. 🔹 Less can be More: Your audience is discerning, and you should be too. Wishing the best of luck to my candidate interviewing today for an *UNPOSTED* and opportunistic role with a top AmLaw firm in #CharlotteNC (not that they need it). This interview is exciting for two reasons: - Opportunistic hiring is starting to come back, even within AmLaw firms, for highly qualified candidates. This shift signals market strength we haven't seen in some time. More lateral opportunities, in diversity and volume, are likely on the horizon for candidates. Moreover, it indicates that clients are becoming less conservative in their hiring plans, which is a positive sign for the financial market. - This marks my first candidate interview in nearly 2 years! In 2022, I took on a managerial role focused on hiring, teaching, and managing teams of recruiters. While I adore my teams and my role as their biggest supporter, I have missed the hands-on experience of running my own desk. I am thrilled to be back in the saddle and actively engaged with candidates, clients, and the market once again!
