It’s the Year of The Dragon, and a time that the Chinese Horoscope says will bring authority, prosperity, and good fortune. We’re keen on this type of outcome after what has been a tricky year for many. Diesel prices trended down but remained high, thanks to events overseas over which Australia had no control. In the face of big inflation numbers making life challenging for most operators, the financial viability of operators remains our biggest issue. Regulatory reform slowed to a crawl in 2023 before governments gave themselves yet another extension in the never-ending overhaul of the Heavy Vehicle National Law. NatRoad opposed this delay, which pushes the introduction of new laws into parliament until 2025 at the earliest, seven long years from when the review commenced. One thing that did move during the last 12 months was industrial relations law. The most significant for our industry was the introduction of a mechanism for the Fair Work Commission (FWC) to set minimum standards for drivers. We continue to roll out the emails providing the link for operators to opt in to the Road Haulage Association (RHA)’s Truck Cartel Claim. Please continue to check your emails over the coming days as the roll out is staggered due to the size of the claim. The RHA brought this claim as what lawyers describe as a “follow-on legal action”. The European Commission fined the European truck manufacturers (DAF, MAN, Iveco, Volvo/Renault, Daimler and Scania) over £3.4bn for serious violations of EU competition rules as they were found to have fixed prices and delayed the introduction of more fuel-efficient emissions technologies. The manufacturers’ guilt has already been proven and the RHA believes that this resulted in operators paying too much for their trucks during the cartel period (1997 to 2011) and for a period of time after this. Broadly speaking, operators should be entitled to be reimbursed for the difference between what you paid for your trucks and what you would have paid if the cartel had not existed. You must opt in to the claim to secure your ability to receive compensation through the RHA’s efforts. The claim is open to operators who purchased or leased trucks over 6 tonnes between 1997 and January 2014 for new trucks or January 2015 for used trucks.
