On 23 July last, we had an interesting Dutch Court decision on the designation of plant-based products. A short summary thereof is as follows. Early 2023, #Upfield launches a plant-based alternative for butter under the well-known margarine brand name #BLUEBAND and the product name #ROOMBETER. The Dutch Dairy Association objects to the use of that product name because according to European regulations, ‘cream’ and ‘butter’, may only be used for dairy products. The Court of Justice of the European Union is strict in interpreting those regulations under its #Tofutown doctrine. The Dutch court rules that it follows from that strict interpretation that the product name ROOMBETER cannot be used for a plant-based product. This is even the case if it is clear to consumers that it does not contain butter. Goede beslissing! Als al die vervangende producten zo goed zijn, dan hebben ze ook geen misleidende namen nodig als Mosa Meat/Burger, vegetarische slager, roomboter, gehackt, etc. Het moet voor de gewone consument volstrekt duidelijk zijn wat er verkocht/gekocht wordt. Het is toch al moeilijk genoeg in de supermarkt met al die Bio en Vega aanduidingen, met vaak forse prijsverschillen.
