Last October, new divorce laws took effect in Maryland. And while this isn’t “new” news anymore, family law attorneys are just now beginning to feel the impact of this new legal landscape. Here’s what you need to know… 1️⃣ Absolute Divorce: Maryland now reduces the separation period from 12 to 6 months, and removes the no-cohabitation requirement. 2️⃣ Grounds for Divorce: "Irreconcilable Differences" is now recognized as a valid ground for divorce, providing a no-fault path forward. 3️⃣ No-Fault Divorce: Maryland has adopted no-fault divorce laws, streamlining the process and removing the need to prove fault and the need for “Limited Divorce.” With these new laws in place, we’re seeing these changes… ✅ Faster Process: Couples can file immediately without waiting for a separation period or filing for a limited divorce first. ✅ Reduced Complexity: The addition of irreconcilable differences as a ground for divorce simplifies divorce proceedings, fostering a more amicable process. ✅ Alimony and Property Division Nuances: The grounds for divorce can still be raised and considered a factor that can impact alimony and division of marital property, requiring careful consideration and expert guidance. These new laws aim to expedite the divorce process, allowing couples to move forward with their lives more quickly and with less acrimony. However, while these reforms offer greater flexibility and efficiency, couples must still handle divorce proceedings with care and should still seek legal guidance to ensure their rights and interests are protected throughout the divorce process. Navigating these changes can be complex. My Team is here to provide clarity and support, ensuring your rights and interests are protected throughout the divorce process. Stuck in the house with your unwanted spouse during the divorce? During your Florida divorce proceedings – that stretch of time between deciding to end your marriage and having the official divorce decree in hand – you may feel adrift in uncharted territory. You are not together, but you are not yet separate. Both of you must make decisions about where to live during this stretch of time. Who stays and who goes? Life together in the marital home pending divorce Because of financial issues, children or other logistical or personal matters, some divorcing couples decide to stay together – but also apart – within the marital home pending resolution of the court proceedings. Today we consider ideas for keeping the peace, avoiding conflict and maintaining privacy during this sometimes-difficult transitional situation. Negotiate house rules Its good to have an agreement about important aspects of the living arrangement. Consulting an experienced family lawyer is smart as they can advise about any legal concerns such as the impact on custody or property interests of staying or moving out. Depending on the current nature of your relationship and whether your spouse is likely to adhere, you may be able to reach agreement informally. However, it may be advisable to have a lawyer help you negotiate and draft the agreement between the two of you. If your spouse drafts it, be sure to have your attorney look it over before signing. Issues to consider: How will you resolve conflict? Can you both commit to keeping it to a minimum, especially in front of children? Will you each have your own room and perhaps other space such as an office? How will you handle the common areas of the home? How will you divide household expenses? If you have children, will you all eat together? How will you divide children’s care, transportation and activities? What about pet care, if applicable? What about use of vehicles? How will chores and lawncare be completed? And others ------------------------------------------------ Law Offices of Forrest & Forrest, PLLC Divorce & Family Law Offices in Boca Raton and Fort Lauderdale www.ForrestESQ.com 561-561-5000 954-800-5000 #divorce #divorcelaw #divorced #FamilyLaw #paternity #DivorcedParents #timesharing #visitation #custody #ChildCustody #ParentingPlan #EquitableDistribution #PropertySettlement #alimony #ChildSupport #FamilyLawyer #DivorcedParents #DivorceCourt #DivorceCoach #lawyer #LawyerLife #FortLauderdale #LasOlas #EastLasOlas #SouthFlorida #FortLauderdaleBeach #MiamiDade #boca #BrowardCounty

In a contested divorce, spouses disagree on key issues, necessitating court intervention. In an uncontested divorce, both parties reach mutual agreement on all terms, simplifying and expediting the process. Contested Divorce ⚖️ Disagreements on Key Issues: Spouses cannot agree on important aspects such as division of assets, child custody, alimony, or child support. ⚖️ Court Involvement: Requires intervention from the court to make decisions on disputed issues, which can lead to a longer and more complex process. ⚖️ Legal Representation: Often involves extensive legal representation and potentially multiple court appearances. ⚖️ Costs: Typically more expensive due to legal fees, court costs, and the extended duration of the process. Emotional Toll: Can be emotionally draining for both parties, often leading to heightened conflict and stress. Uncontested Divorce ⚖️ Agreement on Terms: Both spouses agree on all key issues, such as asset division, child custody, and support arrangements. ⚖️ Simplified Process: Typically involves a streamlined process with minimal court intervention, often allowing for quicker resolution. ⚖️ Legal Representation: May require less legal representation since there’s no dispute, and in some cases, couples may handle the process themselves or through mediation. ⚖️ Costs: Generally less expensive due to reduced legal fees and quicker resolution. ⚖️ Emotional Impact: Usually less stressful, as both parties work cooperatively to reach a settlement. These differences highlight how the level of agreement between spouses can significantly impact the divorce process, costs, and emotional experience. If you are considering divorce, give us a call and let’s find the best course of action for you and your family. #DivorceEducation #NewBeginnings #FamilyLaw #DivorceHelp #OCFamilyLaw

Preparing for Divorce in Orange County: https://bit.ly/42QVNUm. "Divorce is a challenging process both financially and emotionally. Even if you and your spouse are fairly content with the prospect of separation, issues concerning child custody and division of property can rouse resentment and frustration when you least expect it. By fully preparing yourself for the divorce proceedings, you will be able to handle any discrepancies that may arise. At The Law Office of Bruce C. Bridgman, we are fully invested in your divorce from the moment you hire our firm. We will help you anticipate all that your divorce will require of you, so that you can feel confident and prepared. It is important to consider these three critical aspects of your divorce: - Legal representation - Financial standing - Personal behavior #1: Hire an Experienced Divorce Lawyer! If you are considering a divorce without a lawyer, you could face a number of difficulties. Before your divorce can be finalized, you must outline a settlement agreement with your spouse. This document will detail all of the decisions that you and your spouse have made, from division of property and debt to child custody and child support. You and your spouse may be in total accord over the settlement agreement, but if it is written in such a way that confuses or displeases the judge, you may be required to start from scratch, or the judge could intervene and settle the divorce against your best wishes. A competent divorce attorney will know how to complete this settlement agreement in a way that prevents any backlash in court. Ideally, you should interview three divorce attorneys before cutting anyone a check. You want a lawyer with at least five years of experience, but, above all, they must be prepared to settle your case quickly and fight for you if necessary. Attorney Bruce C. Bridgman has over 30 years of family law experience, and his team of divorce lawyers is prepared to take your case to court. Call now to set up a free case evaluation with our firm. Contact us today for your free consultation. If we can help you, even if it's just to answer a question, please feel free to call our office anytime at (949) 679-4250. We're here for you! #Irvine #OrangeCounty #Lawyer #Attorney #FamilyLaw
