Important update from LexisNexis UK: July 2024 guidance contains a number of different going rates to those in the Immigration Rules ‘On 10 July 2024, the Home Office issued a number of revised versions of the guidance documents which set out salary going rates for eligible roles in sponsored routes. At the foot of each of the webpages pages housing the guidance documents, the update note stated that the document had been updated ‘in line with changes to the Immigration Rules’. There have been no changes to the Immigration Rules since Statement of Changes in Immigration Rules HC 590, which was issued on 14 March 2024, and relevant changes from that Statement came into force on 4 April 2024 (at which point these guidance documents were previously updated). However, comparing these documents with the preceding versions reveals that some of the going rates have changed. We understand that the Home Office has confirmed via a message on the Sponsor Management System, and to advisers who have queried this, that there were some errors in HC 590 as regards certain of the going rates figures, and that, pending new Immigration Rules being laid, the rates that the Home Office are relying on are those in the guidance rather than in the Rules. As an example, the standard going rate for Skilled Worker new hires in Standard Occupational Classification (SOC) 2020 code 8232 Marine and waterways transport operatives set out in Table 1 of Appendix Skilled Occupations is £53,200, while the transitional rate for persons already sponsored in that code before 4 April 2024 is £36,700 (Table 2). In contrast, the guidance gives the relevant figures for this code as £33,600 for the standard going rate for new applicants applying with a Skilled Worker Certificate of Sponsorship (CoS) from 4 April 2024 onwards, and £24,200 for those sponsored before 4 April 2024. As such, advisers should use the published guidance rather than the Rules when looking at what is the relevant going rate for a role in sponsored routes. End-of-Administration Immigration Rule Changes: What You Need to Know My clients and staff, who haven't been engaged in immigration law as long as I have are surprised to see the flurry of rule changes and in immigration law at the end of the Biden Administration. While Congress hasn’t made major changes to the immigration system in decades, each administration typically uses regulatory rulemaking to implement its priorities before leaving office. The Biden administration is no exception, which is why we are now seeing updates such as the H-1B rule changesand the J-1 Skills List revision. These shifts highlight how administrations rely on executive and regulatory tools to enact policies that can outlast their term, often leading to last-minute but impactful changes.

As an immigration lawyer, I am incredibly passionate about my work and the opportunity to help people navigate our complex (and outdated) immigration system. However, I hate the the politicization of immigration. The misunderstanding surrounding our legislative process leads to quick blame and misconception about immigration laws. People need to understand how a bill becomes a law before getting angry about new “green card programs for illegals.” Our outdated immigration laws make it easy for click bait articles to fuel anger and resentment towards "illegals." Please pause for a moment and dive deeper into the process. No matter who is in the position of President, they cannot unilaterally create new immigration laws or grant citizenship to people crossing the border with the stroke of a pen. If you are in this country, doing everything right and frustrated with the system, I understand your plight. Trust me, the system is broken! It’s outdated. It needs to be modernized. However, it's crucial to be educated on how laws are passed and not fall into the trap of misleading click bait articles designed to provoke anger.
