TikTok’s Ban: Countdown to January 19th
Alex Wilhelm breaks down the legal battle as TikTok fights its looming U.S. ban:
Key Dates:
Dec 13: DC Court of Appeals denies TikTok's injunction request.
Dec 16: TikTok appeals to the Supreme Court.
Dec 27: Opening briefs due—no holiday breaks for lawyers!
Jan 10: Oral arguments before the January 19th deadline.
⚖️ Supreme Court Rejects Emergency Relief
TikTok's push for an emergency injunction failed, but the legal battle is far from over. The compressed timeline ensures the current DOJ and administration defend the law before potential political shifts in 2025.
The clock is ticking! Do you think TikTok can survive this legal storm?
Just so everyone knows, we've been talking a little bit about TikTok and its legal travails. The ban is in January 19th, right? Isn't that this is fast coming. We're about a month away. We're 30 days away from this. And tick tocks done. Yeah. Well, so on December 13th, the DC Court of Appeals said no to them asking for an injunction against the law. Then on the 16th TikTok file. Dear God, Supreme Court, please come help us. We don't have any time left. Today, the Supreme Court said no to their request for an emergency injunction. But what they did was they've squeezed an entire. Supreme Court petition into between now and January 19th. So it's gonna be yes. So wow, the Supreme Court doesn't usually do that, right? Aren't they usually like slower? Ohh, yeah, so slow. But I the the commentary that I saw that made the most sense to me is that they're compressing this. So that way the current DOJ and the current kind of like set of government that brought this bill and passed it are going to be the ones defending it, which makes I think reasonable sense. So very quickly, everybody be administration, change the new administration. Might have different feelings about this. The old administration should get to dispatch justice here as they see fit, or the court should. And so they just want him. Yeah. Finish, wrap this up before it gets nixed or there's a transition of people, I guess. I guess that seems like a good idea. I think it's reasonable. And then the trouble can do it over the world. Congress can pass a different law. You know, they can. They can, they can go back to the drawing table. But alright, we live in a democracy. There's a there's laws and there's a process for passing these laws. Yes. It it turns out there is a process. We don't use it very often anymore, but we do have one that is in reserve in case we ever decide to legislate. As a nation quickly opening briefs December 27th, right? For Christmas, we'll get the big notes from the government and Tick Tock and then essentially oral arguments January 10th. So this is going to be bang, bang, bang. We're going Christmas for people working at the law firms of TikTok or the DOJ. You got work to do? No skiing for that group. Jason, This is gonna be the biggest. No. What? No. OK, Look, if someone wants to pay me, what? They're going to pay those lawyers to work over double time. Like this is literally the best Christmas ever involved families are like, guess what? Christmas is in February wherever you want it to be. Yeah, exactly. Pick a continent. We'll do it there. We're there. That's what's going on. Everyone. We have our eyes on it. We'll bring you the briefs when they come out. It's going to be a big deal. It's going to be politically charged. Very interesting. And it'll help determine kind of where things go. I retain my position. Divest, divest, divest. I I'm still on that. Fearful for. The Chinese to have this tool, yes, or any or any country to have this tool will be honest, especially in our nation. The clock is ticking on TikTok’s future in the United States.
A federal appeals court has upheld a ruling that could stop TikTok from operating here unless ownership switches from Chinese hands to American hands.

A federal appeals court panel upheld a law on Friday that could lead to a ban on TikTok within weeks.
The U.S. Court of Appeals for the District of Columbia Circuit denied TikTok’s petition to overturn the law—which requires TikTok to break ties with its Chinese parent company ByteDance or be banned by mid-January.

A D.C. Circuit panel today upheld a federal law giving TikTok until January to cut ties with its Chinese parent company or face a ban in the United States, ruling that the statute survives constitutional scrutiny.
A federal appeals court upheld a law last week requiring China-based ByteDance to sell TikTok by January 19 or face an effective ban in the United States.
Here's what that means and where the situation could go from here.

"The Supreme Court has an established historical record of protecting Americans' right to free speech, and we expect they will do just that on this important constitutional issue," TikTok said in a statement following the D.C. Circuit's ruling.
"Unfortunately, the TikTok ban was conceived and pushed through based upon inaccurate, flawed and hypothetical information, resulting in outright censorship of the American people," the company added. "The TikTok ban, unless stopped, will silence the voices of over 170 million Americans here in the U.S. and around the world on January 19th, 2025."
In its 92-page opinion, the D.C. Circuit agreed with TikTok that the company has First Amendment rights.
But the panel said the government’s concerns about Chinese efforts to collect Americans' data and the risk of China manipulating content on the app override free-speech concerns.

U.S. Court Denies TikTok’s Request to Freeze Sale-or-Ban Law TikTok had sought to temporarily freeze a law that requires its Chinese parent to sell the app or face a U.S. ban in mid-January. The case may now head to the Supreme Court.
