The highly-anticipated e-Evidence Package aims to implement a more efficient alternative mechanism to the current regime for cross-border law enforcement requests in the European Union. In setting out significantly reduced periods for data production on valid requests, the e-Evidence Package proposes to considerably expediate the production of requested data when compared to current periods. ⚖ Very honored to contribute to the 𝑪𝒐𝒎𝒑𝒍𝒊𝒂𝒏𝒄𝒆 𝒆𝒕 𝒅𝒓𝒐𝒊𝒕𝒔 𝒅𝒆 𝒍𝒂 𝒅é𝒇𝒆𝒏𝒔𝒆 book (“Compliance and defense rights”) which has been recently published by Journal of Regulation & Compliance  and Editions Législatives | Lefebvre Dalloz. A welcome opportunity to address some of the pitfalls practitioners face in large groups when conducting internal investigations.   While France has now adopted the concept of compliance programs and settlements to resolve issues, it has not made the final mile yet: in-house lawyers do not enjoy the same status as their peers in private practice and the protection of attorney-client correspondence is limited in criminal matters. Consequently, they must enforce strict ethical standards while at the same time avoiding to add trouble for their business.
