A number of leading Group Club speakers joined the salvage industry at Seatrade Maritime Events' annual Salvage and Wreck Conference in London this week. Amongst the topics discussed, Group CEO Nick Shaw led an engaging conversation alongside Sam Kendall-Marsden and other industry experts on the salvage industry’s preparedness for casualties involving alternative fuels. The session also touched on the difficulties presented when ships in distress are not offered a port of refuge. Capt Ajaz Peermohamed joined a panel looking at how a casualty involving a very large container vessel would be managed, including how industry can best collaborate with government in high profile and complex casualties. Andreas Brachel spoke about how ESG can be incorporated into casualty response efforts drawing a clear distinction between the immediate emergency response and subsequent wreck removal phase. This led to an engaging debate about whether incorporating ESG into casualty response costs more in practice. Thanks to all the Group Club speakers also including Ben Harris, Nina M. Hanevold-Sandvik and Edward Wollaston. As the industry grapples with decarbonisation, other ESG issues, War, and Sanctions, increased media interest in wreck removals, plus other emerging risks and issues, not least how to recruit and train the salvors of the future, it was good to see the Group Clubs front and centre in these conversations. #salvage #maritime #PandI

SMIT SALVAGE B.V. AND OTHERS (SMIT)v LUSTER MARITIME S.A. AND ANOTHER (Owners). On the 19 March 2024 the Court of Appeal delivered its judgment. Appealing the Admiralty judge’s decision, the Owners argued that a contract as to the remuneration to be paid to the salvors had been concluded, precluding a claim for salvage under the International Convention on Savage 1989 or at common law. The Court of Appeal disagreed. Reaffirming the legal principles related to contract formation, the case highlights that careful consideration must be given when trying to agree terms via email and/or telephone exchanges. Though terms such as ‘subject to contract’, ‘subject details’ or ‘fixed on subjects’ can be used to make clear that parties have not yet reached the stage of a binding contract, the absence of such terms (as in this case) is not decisive. What matters is the parties’ words and conduct towards each other, considered in their context. The decision Agreeing with the Admiralty judge’s decision, the Court of Appeal concluded that the parties’ exchanges fell ‘considerably sort’ of unequivocally evincing an intention to be bound, essentially for the reasons put forward by SMIT.

King Triton rules the underwater kingdom of Atlantica and is protective of his daughter, Ariel, but he never discusses her future role in the kingdom or makes provisions for his estate. Ariel’s desire to live on land leads to conflict with her father, who doesn’t understand her wishes. A family meeting about Ariel’s future and a transparent conversation about Triton’s intentions for the kingdom would have helped avoid tension. Estate planning should involve communicating with heirs to ensure everyone’s expectations and desires are understood, especially when non-traditional plans (like Ariel’s desire to live on land) come into play. Learn from King Triton's mistake and communicate your estate plans clearly with your loved ones. Don't wait for tension to arise – start the conversation today to ensure everyone's wishes and expectations are understood. Contact us for expert guidance on transparent and effective estate planning that fosters harmony and understanding within your family. https://lnkd.in/ejNEhSbU #EstatePlanning #NJLawyer #WillsAndTrusts #Probate #LegacyPlanning #FamilyWealth #Inheritance #EstatePlan #EstateAttorney #ProtectYourAssets #ElderLaw #Guardianship #LivingWill #EstateTax #HealthcareDirective #PowerOfAttorney #Beneficiary #EstateLaw #BusinessLaw #BusinessFormation #ContractLaw #SmallBusiness #CommercialLaw #EmploymentLaw #BusinessOwner #BusinessContracts #RealEstateLaw #BusinessCompliance #BusinessLitigation #NewJerseyBusiness
