IEL’s latest featured In-house Leader is Rebecca McAlees, Senior Global Employment Counsel at Unilever. “Those who adopt AI will be further ahead than those who don’t. I am less concerned about AI replacing my job and more concerned about being replaced by someone who can use AI,” she says. Click here for McAlees’ survey responses, including on where to start when rolling out a large multijurisdictional workforce-related project, and why someone considering the move in house should “try before they buy” with a secondment.

I’m excited to share my latest article, published by the OBA’s Labour & Employment Law Section, where I explore Jarvis v. The Toronto-Dominion Bank (2024 ONSC 3853) and its impact on workplace investigations and just-cause terminations. I also had the pleasure of presenting these insights as part of the “Keeping Up with the Case Law” series. See below for more details!
Mediator & Arbitrator for employment, civil & estates disputes | Settlement Counsel | I solve legal problems
A recent Superior Court decision serves as a crucial reminder for employers to “think carefully before assuring complainants that their complaints can and will be kept confidential,” especially if those complaints will be used to justify a termination for cause. Tiana Terrigno penned the latest article to be added to the Ontario Bar Association Labour & Employment Law Section collection, which I am proud to edit this term. Recently, Tiana spoke about this decision at our popular "Keeping up with Case Law" series: https://lnkd.in/gMs4_n_H. If you have an idea for an article that you would like to pitch, feel free to DM me here, or email me at [email protected]. And for those of you reading this post who were waiting for the punchline, all I can say is that I have my serious side. But stay tuned. https://lnkd.in/gbmzBVj9

I was pleased to recently add two employment law related articles to the Ontario Bar Association Labour & Employment law section webpage from the folks at Gowling WLG's Employment, Labour & Equalities Group in Toronto & Ottawa: https://lnkd.in/gbmzBVj9. We have Carson Healey explaining how Ontario’s courts have once again proven that serious consequences ensue for employers who do not protect their employees from harassment. In Stride v. Syra Group Holdings, the court issued an award of $125,000 in human rights damages and $50,000 in moral damages for the abusive and harsh treatment the plaintiff endured. We also have Andrew Bratt, Drew McArthur & Rachel Corwin's piece about why, notwithstanding the increasing scrutiny and frequent invalidation of termination provisions by trial judges, it is still worthwhile for employers to include restrictive termination provisions in employment contracts as there are numerous examples of courts upholding the language when properly drafted. The write about the latest example, being Bertsch v. Datastealth. If you are interested in submitting an article, which may make it into the bi-monthly Section Insider newsletter, please pitch your idea to me at [email protected]. #employmentlaw #ontariolaw #wrongfuldismissal #harassment
