HUD has extended foreclosure moratoriums on Federal Housing Administration and HUD Office of Housing-insured single family mortgages for areas devastated by Hurricanes Helene and Milton. The moratoriums on foreclosures will remain in effect through April 11, 2025.

***FAPA DECISION OF FIRST IMPRESSION IN NY*** We received an excellent decision of first impression for our client in a residential foreclosure matter in Supreme Court, Westchester County. In response to our Motion for Summary Judgment, the borrower cross-moved seeking leave to interpose an answer concerning statute of limitations, specifically that commencement of our action was barred by NY’s Foreclosure Abuse Prevention Act (“FAPA”). Concerning foreclosures, under FAPA the savings provision of CPLR 205(a) was replaced by CPLR 205-a to mandate that only the plaintiff from the initial foreclosure action may commence a new foreclosure action within six (6) months following the dismissal of the initial action. In this case, a prior foreclosure action was commenced in 2013 on the same mortgage loan. After dismissal of the 2013 Action, a second action was commenced by our client. Our client had purchased the loan during the pendency of the 2013 action and opted to continue to pursue the 2013 Action in the name of the prior plaintiff. Our client remained the owner of the Loan at the time the 2013 Action was dismissed and subsequently commenced a new action within the six (6) month extension period in its own name. The Judge determined that FAPA did not bar our client from commencing the second action during the six (6) month extension window because we established that our client owned the loan during the pendency of the first action. This decision has enormous implications for the application of FAPA throughout NY State. Please reach out to [email protected] to discuss this and other foreclosure related issues in more detail.

🚨 Freddie Mac and Fannie Mae are offering mortgage relief options for homeowners and renters impacted by Hurricanes Helene, Milton, and other natural disasters. Both agencies provide up to 12 months of forbearance without late fees or foreclosure, allowing affected homeowners to temporarily reduce or suspend their mortgage payments. Servicers may also offer a 90-day forbearance if they believe a property was impacted by a disaster, even without direct contact with the homeowner. After forbearance, homeowners have several options to resolve missed payments, including payment deferrals and loan modifications. Both Freddie Mac and Fannie Mae provide resources for disaster recovery, with Fannie Mae offering free counseling through HUD-approved experts via 855-HERE2HELP (855-437-3243), and Freddie Mac offering support through its My Home website.
