Handling Forex Risks in Transfer Pricing: Very interesting article from Suhash Kantamneni. The article highlights alternative options as regards the treatment of Forex gains and losses. Although these issues are not always material, in some cases they can be extremely significant. As for any risks, attempting to contractually allocate Forex risks after the event is unlikely to be robust. Thought therefore needs to be given to design, implement and document an appropriate transaction in advance. @ Flavia Garcia it would be great to resume our conversations about these issues!

𝐃𝐢𝐬𝐩𝐚𝐫𝐢𝐭𝐲 𝐢𝐧 𝐂𝐚𝐩𝐢𝐭𝐚𝐥 𝐆𝐚𝐢𝐧𝐬 𝐓𝐚𝐱𝐚𝐭𝐢𝐨𝐧 This is beyond logic that one limb (2nd proviso to Section 48) providing protection from tax on inflation is removed but the one which provides protection from forex fluctuation (1st proviso to Section 48) is left untouched. Both are the result of economic activities on which the taxpayers have no control at all but jeopardising one section of taxpayers just because they choose to be here seems somewhat unjustified. #capitalgainstax #capitalgains #incometax #UnionBudget2024 #FinanceBill2024 #inflation #indexation

Do you have a sound Hedging strategy? To mitigate the risks associated with currency fluctuations, businesses may use hedging strategies, such as forward contracts or options, to lock in exchange rates for future transactions. The tax treatment of gains or losses arising from hedging activities can vary depending on the jurisdiction and the specific hedging instrument used. Businesses must consider the tax implications of their hedging strategies when engaging in cross-border transactions. #businessconfidence #canadianinvestors
