NEWSFLASH: 🇲🇿 Mozambique: Opposition leader Venancio Mondlane faces legal action Mozambique’s Attorney General has filed a civil lawsuit against opposition leader Venancio Mondlane, who is currently in exile, accusing him of inciting unrest following allegations of electoral fraud. Authorities are seeking over 30 million meticais (approximately 480,000 euros) in damages for destruction caused during protests in Maputo. Mondlane has been calling for demonstrations since mid-October, denouncing what he claims is widespread fraud in the recent presidential election. In addition to the civil suit, Mondlane is implicated in a criminal case against Vitano Singano, leader of the Democratic Revolution Party, who is accused of conspiring to attack the presidency. The alleged plot coincided with a major protest called by Mondlane on November 7. Protests have resulted in significant casualties, with the UN reporting at least 30 deaths and civil society groups claiming over 60 fatalities. The present nature of the Ghanaian legal landscape regarding the right protest and demonstrate is unfortunately fraught with controversy, tension and animosity. The conversation is expansive, complex and requires a nuanced approach. Firstly, regarding the arguably obsolete Public Order Act, 1994 (Act 491) and the seeming abuse of its provisions by the Ghana Police Service by applying for injunctions to protests late (I wrote relating to this here: https://shorturl.at/4Nncm). Secondly, regarding what protesters can and cannot do within the ambits of the Freedom of Expression as exists under Article 21 of the Constitution. Thirdly, the manner through which our prosecutorial agencies handle protestors accused of illegality. It is in the best interest of the state and it's citizens that reforms are made to the existing legal system to better protect rights of citizens and allow for citizens to voice their displeasure. Elections cannot be the only way.

The Nigerian government's response to the impending protest exemplifies a egregious disregard for democratic norms, precipitating a crisis of accountability. The administration's attempts to discredit the movement and deflect attention from its own failures only serve to underscore its desperation and fear of transparency. The situation underscores the imperative of proactive governance, as the adage "prevention is better than cure" aptly illustrates. In the wake of the ongoing countrywide protest dubbed #RejectFinanceBil2024 and #RutoMustGo, several abductions have been reported so far. I, at the instructions of the Law Society of Kenya, instituted a habeas corpus application seeking the presentation to court of all the abductees held incommunicado by the Kenya Police and the National Intelligence Service. Even though all the 12 persons in the petition were later released, we are determined to seek for a declaration that it was these two institutions that unconstitutionally abducted and held them incommunicado for over 24 hrs contrary to the laws of the land. We equally demand that the Government of Kenya compensates them for unlawful detention and torture. In so doing, the learned judge agreed with us and issued an Interim Conservatory order restraining the respondents, their agents and or servants from abducting the 2nd to 13th once released, and or any other PERSON WHO IS PEACEFULLY PROTESTING AND HOLDING THEM INCOMUNICADO, until the determination of the application and petition. Our determination to ensure rule of law remains undeterred. We shall continue defending everyone expressing dissatisfaction against a rogue regime that abducts and tortures its people.
