This post may ruffle some feathers... #Titleinsurance, at its core, is a relationships business. Because of the work that goes into clearing title, attorneys and realtors want to drive business to people that they know, like, and trust. Once a title agent betrays that trust by doing a poor job, those partners begin to look elsewhere. This dynamic elevates the industry, drives claims lower, and ultimately decreases title premiums. #Jointventures have thrown a wrench into the life cycle of title relationships. It adds an additional variable into the equation of good work leading to stronger relationships. More importantly, profit sharing can lead #titleagencies to look elsewhere to find margins. This can lead to diminished service, higher fees, and cut corners. As we, as an industry, embrace joint ventures (and fail to enforce non-compliant joint ventures), are we creating the right #incentives to elevate the #titleindustry?

There is another, larger class of brokerages and entities that are not immediately protected by the settlement. If a company falls outside a certain size, they have the option to join the settlement, but will have to pay extra.
