The tragic and untimely death of Boeing whistleblower John Barnett on Saturday is a wake up call for the need to provide greater psychological and social support for whistleblowers. Nonprofits like Whistleblowers of America exist to provide vital peer-to-peer support groups for whistleblowers mediated by therapists/mental health professionals to help deal with the isolation, anxiety and other stressors that accompany the whistleblowing experience. But what about the lawyers, journalists, H.R. professionals, compliance officers, auditors and investigators who are often the first point of contact for whistleblowers speaking up about corporate wrongdoing? As a lawyer who has had the privilege of representing whistleblowers for over 25 years, I have been dismayed by how ill-equipped we whistleblower lawyers are to prepare our clients for the psycho-social impacts of whistleblowing and to support them in their journey (or advise them against whistleblowing in the first place). Inspired by Rena P. and Margaret Gandy at Alcalaw LLP, I've learned to take a more humanistic and trauma-informed approach to my lawyering, which has allowed me to do things like alert my clients to the fact that recounting their experience for regulators/prosecutors, as my clients frequently must do, can be triggering for them and find creative ways to alleviate the discomfort by taking regular breaks in the testimony to check in and emphathize. Unfortunately, as the context of Mr. Barnett's death makes clear, occurring as it did in the midst of a multi-day deposition where he had to testify under oath to support his retaliation claims and relive that painful experience, we need to do more to build effective support systems around our whistleblowers and that starts by sensitizing and training those of us who work with whistleblowers.

Many whistleblowers go down this dark path. The reprisals can be too much, too long, and without support things can look like they'll never improve. It can seem crazy, the way wrongdoers will act without restraint or sanction, while people you trusted turn on you - or just start to ignore you. After a while, it even becomes too much for friends and family to hear over and over. For me, it was my kids that kept me grounded, and other whistleblowers who helped me see that it wasn't me that was crazy. That, and perhaps some resilience built when I was in uniform. In a way, perhaps I was lucky. Not everyone is. Some advice based on personal experience to other whistleblowers: It will get better. It takes time, but eventually the reprisals stop and some form of vindication comes. You can keep fighting while you have the strength, but find allies. Other whistleblowers are the best, because they get it. That said, it's also important to know when to let go, when to stop looking back - and start looking forward. Don't surrender to cynicism and bitterness, but do find a new passion, forgive those who abandoned you out of fear (but not those who betrayed you), and take comfort in the fact you had integrity when others didn't. People did notice, and they do admire you for it. Rest in peace, John Barnett.

Under the agreement with #US #Prosecutors #Boeing faces a #Criminal fine of as much as $487.2 #Million — the maximum allowed by #Law — though the actual amount will be determined by a judge. Typical for large companies not only to have this sham of a whistleblower line, but to also retaliate, threaten or terminate the person that reports. Profits first rules all over. Whistleblower/integrity lines actually identifies who the company perceives as a troublemaker, then threats and dismissal ensues.
