It’s been a few days since the FDA granted an extension from Enhanced Drug Distribution Security Requirements of the DSCSA for eligible trading partners. The FDA considers eligible trading partners those who have “successfully completed or made documented efforts to complete data connections with their immediate trading partners, but still face challenges exchanging data.” With the stabilization period concluding in well under two months, the announcement was monumental and has major implications across the pharmaceutical industry. The announcement not only includes the specific regulations of the DSCSA eligible trading partners are exempt from, but also, what’s expected of them if they choose to take the exemption. The announcement states, “As a condition of the exemptions from certain DSCSA requirements described in this document, the FDA expects eligible trading partners to communicate their reliance on the exemptions to their trading partner.” Per the FDA, those who choose to take advantage of the extension must notify their trading partner(s) when doing so. These exemptions, the FDA adds, “also extend to transactions of product with trading partners [where applicable]”. Eligible trading partners need to notify their trading partners of extension reliance through “a readily accessible resource or communication”, and must “provide a mechanism by which trading partners can confirm the applicability of the exemptions”.  This helps keep trading partners (and the entire supply chain) on the same page.
