BBC reports: "Concussion lawsuit legal firm under investigation". An interesting development arising from the well publicised group litigation against rugby governing bodies. The firm representing around 900 claimants is accused of pressurising a former client into joining the group action. Some serious allegations raised against the firm in question which, as reported, will be investigated by the Solicitors Regulation Authority. No doubt these issues will be properly investigated but for me, this is yet another reminder of the importance of ensuring the retainer is correct and clear from the outset. Often as litigators, we are keen to deal with the issues in dispute and deal with impending deadlines. However, the importance of a clear and compliant retainer is essential (not implying this does not occur in the reported case). Not an aspect that should be taken lightly or over-looked.
