The Dutch Data Protection Authority (AP) sounded the alarm on data breaches linked to the use of 𝗮𝗿𝘁𝗶𝗳𝗶𝗰𝗶𝗮𝗹 𝗶𝗻𝘁𝗲𝗹𝗹𝗶𝗴𝗲𝗻𝗰𝗲 (𝗔𝗜). 🛡️ The AP revealed that employees using AI chatbots without proper authorization have led to several data breaches. For example, a GP practice employee shared sensitive patient medical data with a chatbot—a clear violation of employer policy. Similarly, a telecoms company reported that an employee entered customer addresses into a chatbot, risking data security. 𝗞𝗲𝘆 𝗧𝗮𝗸𝗲𝗮𝘄𝗮𝘆𝘀: ✅ Organizations must establish clear guidelines and agreements with employees regarding the use of AI tools. ✅ Even when AI use is permitted, it’s crucial to define what types of data are allowed to be entered. Safety Testing: AI developers are required to test models for potential harm before deployment, including their capacity to cause large-scale damage (e.g., cyberattacks or the development of weapons). Developers must provide a "positive safety determination" certifying that their models are safe. 2. Hazardous Capability Mitigation: Developers must assess whether their models possess "hazardous capabilities," such as enabling cyberattacks or creating dangerous weapons, and implement protocols to mitigate those risks. They must ensure that safety measures are in place throughout the model's life cycle, including post-training modifications. 3. Full Shutdown Capability: Developers must have the ability to fully shut down the operation of AI models in case they pose an immediate threat or are misused. 4. Security Protocols: Companies must establish cybersecurity protections to prevent unauthorized access, misuse, or unsafe modifications of AI models. This includes protection against advanced persistent threats and securing the model weights. 5. Whistleblower Protections: SB 1047 includes provisions to protect employees who report concerns or violations related to the safety of AI development. 6. Public Transparency and Certification: Developers are required to submit certifications of safety determinations to the Frontier Model Division, a regulatory body created under the bill, and ensure compliance with these statutory requirements.
