I begin most weekday mornings by catching up on legal and relevant (pharma) industry news. I find this helps me better support my clients and it also appeals to my intellectual curiosity (I'm a nerd at heart). This morning, I was particularly happy to run across this Law360 article titled "Riding My Peloton Bike Makes Me A Better Lawyer." Anyone who knows me well knows that I have a slight addiction...... While I have not met the author, we definitely have similar opinions as it relates to discipline, networking and confidence. I particularly agreed with this insight: "Now when I do not want to work out, I work out. That discipline carried over into my practice. I was able to compartmentalize better, focus on each task at hand, and provide a better work product to all involved — whether that was my clients or the members of our firm and practice group." Every Lawyer working in Life Sciences should bookmark this, and share with colleagues: a podcasts series examining typical agreements or clauses in Life Sciences deals. Each episode includes both overviews for people new to these deals, and tips for more seasoned negotiators. Really useful stuff.

The major takeaway from the last stop of my 2024 LMA tour: Embrace the power of the pre-made decision. Along with Cheryl Bame and Traci Stuart, I spoke to the CMO pre-conference at the LMA Tech West X Southwest Conference. Our topic, “To Speak or Stay Silent: The Dilemma of Law Firms,” addressed when, how and whether law firms should comment on social and political issues. While the context is different at every firm, the prep work is the same…and it all comes down to those pre-made decisions. ⭐ Who are we, and what do we stand for? Whether your firm is speaking out often depends on your culture, so it’s key to have your core values spelled out (and published!) before an emergency. You may not be able to plan for every possible contingency, but written principles will guide your decision-making and keep you consistent. ⭐ Practice, practice, practice. Review your geographic markets, client mix and practices, and come up with some scenarios that are reasonably likely to occur. Practice how the firm would respond. You’ll have much better insight brainstorming with your peers in a low-pressure conference room than a surprise email from Above the Law. ⭐ Policy is your friend. What are the hard “no” issues where you will never comment? Do you plan to not comment on anything at all? What about lawyers' social media accounts? Draft a policy (and publish it!) so you can refer back to it if/when things get squirrely. A notable absence in this presentation was our colleague Elizabeth Lampert, who has been such a passionate champion for this subject in the legal profession. While networking with local #GeneralCounsel this week, three topics emerged related to outside counsel engagement. Let's break these down... ⭕ Variable Quality: Different attorneys or law firms may have varying levels of expertise, experience, and work quality, which can lead to inconsistent legal advice and outcomes. ⭕ Understanding Client Needs: Some attorneys may not fully grasp the client’s business, industry, or specific legal needs, resulting in advice that is not tailored or relevant. ⭕ Client Prioritization: Law firms may allocate resources differently, leading to uneven performance if less experienced or lower-priority teams handle certain matters. So, how can a busy law firm help alleviate these challenges? Two words: client listening Without it, you run the risk of: ❌ Losing Client-Focus: Disconnected from client needs and missed improvement opportunities. ❌ Client Dissatisfaction: Unaddressed issues leading to client attrition and potential reputation damage. ❌ Competitive Disadvantage: Falling behind competitors, operational inefficiencies, and weaker client relationships.
