A bit similar to trademark availability searches (see our post from 22 February 2024), ‘freedom to operate’ studies can help to determine whether patents have been filed or granted in a particular territory for a similar invention. It may also help to avoid unintentionally infringing third parties' rights and to avoid marketing a technology that cannot be protected. Such search will utimately help to draft an IP strategy, monitor your competitors, and reveal new business opportunities.
