Conflict checks. Are they necessary for eDiscovery vendors? While this is not a new issue, recently we were approached by two of our clients about working on new cases and we discovered we were already working on the same matter with opposing counsel. One was open to us working with both sides as long as we had a different team working with the data, the proverbial “ethical wall.” The other didn’t want us involved with opposing counsel working on their case. Basic tags in eDiscovery Document Review - eDiscovery Document Review is a crucial stage wherein legal professionals examine the gathered documents for Responsive and Privilege criteria. The basic tags used in eDiscovery Document Review are:- 1) Responsive A document/information which is related to the case is tagged under Responsive criteria. 2) Not Responsive Any document/information which is irrelevant (not related) to the case is tagged under Not Responsive criteria. 3) Privileged Any document which discloses a communication between a client and its attorney seeking a legal advice is tagged under Privilege criteria. Every Privilege document is a responsive document. 4) Not Privileged This tag is used to a document which does not falls under Privilege tag. 4) Confidential The confidential tag is used for a document which consists of confidential information. 5) PII PII (Personal Identifiable Information) tag is used to a document which consists of personal information such as personal contact numbers, passports, personal address, driving license and any other personal information as per the client. 6) Hot A hot tag is used for hot documents. These documents contains crucial information/evidence of the case.
